{"id":107049,"date":"2015-12-13T09:06:15","date_gmt":"2015-12-13T07:06:15","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=107049"},"modified":"2015-12-13T09:06:15","modified_gmt":"2015-12-13T07:06:15","slug":"motsoenengs-disciplinary-hearing-is-a-mockery","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/107049\/motsoenengs-disciplinary-hearing-is-a-mockery\/","title":{"rendered":"Motsoeneng&#8217;s disciplinary hearing is a mockery"},"content":{"rendered":"<p>Following SABC COO\u00a0Hlaudi Motsoeneng being\u00a0<strong><a href=\"http:\/\/mybroadband.co.za\/news\/broadcasting\/149567-hlaudi-motsoeneng-cleared-of-all-charges-in-disciplinary-hearing.html\">cleared of misconduct charges<\/a><\/strong>,\u00a0the hearing was criticised as being unnecessary after the <strong><a href=\"http:\/\/mybroadband.co.za\/news\/broadcasting\/147689-sabc-and-hlaudi-motsoeneng-in-contempt-of-court-da.html\">Western Cape High Court<\/a>\u00a0<\/strong>previously nullified his appointment.<\/p>\n<p>According to a report in the Sunday Times, the SABC conducted the\u00a0\u201cflawed disciplinary hearing\u201d despite legal advice that Motsoeneng is not an employee of the broadcaster.<\/p>\n<p>Advocate William Mokhari was the initial chairman of the hearing, and told the SABC that going ahead with the hearing was a \u201cfutile exercise as Motsoeneng was no longer in the employ of the broadcaster\u201d.<\/p>\n<p>\u201cMokhari stopped\u00a0the hearing on a legal technicality, but the broadcaster ignored his advice and continued without him,\u201d said the report.<\/p>\n<p>\u201cHe [Motsoeneng] is no longer the COO. You can only discipline a person if there is an employer-employee relationship.\u00a0That [high court] judgment is effective until it is reversed by another court,\u201d said\u00a0Mokhari.<\/p>\n<p>\u201cI have made a ruling. My ruling is final and binding unless they take it on review.
