{"id":111085,"date":"2016-02-02T19:30:19","date_gmt":"2016-02-02T17:30:19","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=111085"},"modified":"2016-02-02T16:48:39","modified_gmt":"2016-02-02T14:48:39","slug":"smacking-your-child-may-soon-be-illegal-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/lifestyle\/111085\/smacking-your-child-may-soon-be-illegal-in-south-africa\/","title":{"rendered":"Smacking your child may soon be illegal in South Africa"},"content":{"rendered":"<p>South African law is murky when it comes to corporal punishment in the home &#8211; but some parents, along with the Human Rights Commission and international organisations are pushing to have the practice outlawed completely.<\/p>\n<p>The South African Human Rights Commission has called on government to put an end to corporal punishment at home, recommending that Cabinet criminalise spanking and other forms of physical discipline.<\/p>\n<p>There are currently only 49 countries across the globe that have an outright ban on corporal punishment in all forms.<\/p>\n<p>These include countries such as Denmark, Germany, Spain, Kenya and even the Democratic Republic of Congo.<\/p>\n<div id=\"attachment_111087\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-111087\" class=\"wp-image-111087\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/02\/Outlawed-Corporal-Punishment.jpg\" alt=\"Outlawed Corporal Punishment\" width=\"600\" height=\"346\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/02\/Outlawed-Corporal-Punishment.jpg 2431w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/02\/Outlawed-Corporal-Punishment-300x173.jpg 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/02\/Outlawed-Corporal-Punishment-768x443.jpg 768w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/02\/Outlawed-Corporal-Punishment-1024x591.jpg 1024w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/02\/Outlawed-Corporal-Punishment-640x369.jpg 640w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><p id=\"caption-attachment-111087\" class=\"wp-caption-text\">Outlawed Corporal Punishment (click to enlarge)<\/p><\/div>\n<p>South Africa outlaws corporal punishment in all areas except for the home &#8211; something which may soon change.<\/p>\n<p>Corporal punishment in schools was abolished in 1996 with legislation making it illegal for teachers and other educators to physically harm children as a form of discipline.<\/p>\n<p>However, these laws do not prohibit physical discipline at home.<\/p>\n<p>According to global lobby group <a href=\"http:\/\/www.endcorporalpunishment.org\/progress\/country-reports\/south-africa.html#research\" target=\"_blank\">End Corporal Punishment<\/a>, South African parents are protected under common law, which states that they have the power \u201cto inflict moderate and reasonable chastisement on a child for misconduct.&#8221;<\/p>\n<p>This is provided that it is not done in a manner offensive to good morals or for objects other than correction and admonition.<\/p>\n<p>This power can also be delegated to a person acting in a parent&#8217;s place (except for teachers and educators which are prohibited by law).<\/p>\n<p>The law is clear about child abuse.
