{"id":111855,"date":"2016-02-09T10:57:03","date_gmt":"2016-02-09T08:57:03","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=111855"},"modified":"2016-02-09T10:57:03","modified_gmt":"2016-02-09T08:57:03","slug":"mtn-is-being-sued-again-in-nigeria","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/mobile\/111855\/mtn-is-being-sued-again-in-nigeria\/","title":{"rendered":"MTN is being sued again in Nigeria"},"content":{"rendered":"<p>Abu Dhabi headquartered telecoms company Etisalat is suing MTN for the second time in under a year in Nigeria.<\/p>\n<p>Etisalat confirmed to Bloomberg on Monday that it is suing MTN over the latter\u2019s purchase of Nigerian internet provider Visafone Communications.<\/p>\n<p>Etisalat said MTN\u2019s purchase could create a dominant data services market player in Nigeria, harming competition.<\/p>\n<p>MTN confirmed to Fin24 that Etisalat Nigeria has served it with a court summons based on a lawsuit.<\/p>\n<p>But MTN added that it\u2019s not the first time it\u2019s been sued in Nigeria by Etisalat.<\/p>\n<p>\u201cIn July 2015, the company (Etisalat Nigeria) filed a suit against the NCC (Nigerian Communications Commission) and MTN, at the Federal High Court, Lagos, seeking a number of orders including an order of mandamus to compel NCC to direct MTN to withdraw its 11kobo per second tariff plan, amongst others,\u201d said MTN in an emailed statement to Fin24.<\/p>\n<p>\u201cThis was the same tariff plan widely advertised and being charged by other networks including Etisalat and approved by the NCC.<\/p>\n<p>\u201cMTN filed a preliminary objection challenging the suit, and on December 2, 2015, Etisalat\u2019s action was dismissed by the court with costs awarded in favour of NCC and MTN,\u201d said the company.<\/p>\n<p>Regarding the latest court action by Etisalat, MTN Nigeria executive Amina Oyagbola said the acquisition of Visafone was concluded after obtaining statutory and regulatory approvals.<\/p>\n<p>However, Oyagbola was not willing to comment further on the lawsuit as the matter is \u201csub judice\u201d.<\/p>\n<p><strong>MTN\u2019s fine challenge<\/strong><\/p>\n<p>The NCC last year slapped a $3.9bn fine on MTN Nigeria after the mobile network failed to disconnect five million SIM cards in a timely manner.<\/p>\n<p>MTN Nigeria is challenging the fine in court.
