{"id":128469,"date":"2016-06-28T21:17:49","date_gmt":"2016-06-28T19:17:49","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=128469"},"modified":"2016-06-28T21:17:49","modified_gmt":"2016-06-28T19:17:49","slug":"cape-paper-forced-into-front-page-apology-to-helen-zille-over-spook-claims","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/media\/128469\/cape-paper-forced-into-front-page-apology-to-helen-zille-over-spook-claims\/","title":{"rendered":"Cape paper forced into front page apology to Helen Zille over spook claims"},"content":{"rendered":"<div id=\"content-text\" class=\"panel-pane pane-node-body\">\n<div class=\"pane-content\">\n<div class=\"field field-name-body field-type-text-with-summary field-label-hidden\">\n<div class=\"field-items\">\n<div class=\"field-item even\">\n<p>The Press Council\u2019s Appeals Panel has found in favour of Premier Helen Zille in a complaint against the <em>Cape Times<\/em>.<\/p>\n<p>The Appeals Panel ordered the <em>Cape Times<\/em> to \u201capologise for and retract the statement that Mr Scheepers was \u201cZille\u2019s Spook\u201d.<\/p>\n<p>The Cape Times repeatedly made false allegations (stated as fact) on its front page over the course of several months, beginning in November last year.<\/p>\n<p>Premier Zille\u2019s spokesperson Michael Mpofu, appealed to the Press Council\u2019s Appeals Panel following an original Press Ombudsman\u2019s ruling in favour of the <em>Cape Times<\/em>.<\/p>\n<p>Despite the ongoing appeals process, the <em>Cape Times<\/em> continued to run repeated front page stories using the false and defamatory statement, including one occasion on posters deployed throughout the Metro.<\/p>\n<p>Judge Bernard Ngoepe, Chair of the Appeals Panel, issued a ruling against the <em>Cape Times<\/em>, over-turning the original ruling by the Press Ombudsman.<\/p>\n<p>During the course of the hearing the <em>Cape Times <\/em>was repeatedly asked what proof they had to justify their claim that Mr Scheepers was employed to spy for the Premier. The newspaper could provide no credible answer to this question.<\/p>\n<p>The reason for this, Judge Ngoepe found, was that Scheepers\u2019 company had never been contracted to spy on anyone but only to de-bug the phones of Western Cape Cabinet members. The Panel concluded that \u201cdebugging is the very antithesis of spying\u201d.<\/p>\n<p>The Panel also found that the Cape Times had used a single anonymous source \u201cwithout testing the veracity\u201d of the claims made.<\/p>\n<p>The newspaper has been ordered by the Appeals Panel to:<\/p>\n<ul>\n<li>Run a front page apology to Premier Zille and retraction of the story within 14 Days.<\/li>\n<li>Obtain the approval of the Appeals Panel before publishing the apology.<\/li>\n<li>To afford Premier Zille a Right of Reply in the same edition in which the apology is published.<\/li>\n<\/ul>\n<p>Premier Helen Zille welcomed the ruling of the Appeals Panel.<\/p>\n<p>\u201cJudge Ngoepe\u2019s ruling that the <em>Cape Times<\/em> repeatedly violated the press code brings to an end a long smear campaign against me and the Western Cape Government by this newspaper.
