{"id":137169,"date":"2016-09-19T09:45:03","date_gmt":"2016-09-19T07:45:03","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=137169"},"modified":"2016-09-19T09:46:03","modified_gmt":"2016-09-19T07:46:03","slug":"yuppiechef-and-yuppie-gadgets-fight-over-yuppie-name","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/broadband\/137169\/yuppiechef-and-yuppie-gadgets-fight-over-yuppie-name\/","title":{"rendered":"Yuppiechef and Yuppie Gadgets fight over &#8216;Yuppie&#8217; name"},"content":{"rendered":"<p>The prolonged legal battle between <a href=\"https:\/\/www.yuppiechef.com\/\" target=\"_blank\"><strong>Yuppiechef<\/strong><\/a> and <a href=\"https:\/\/www.yuppiegadgets.com\/\" target=\"_blank\"><strong>Yuppie Gadgets<\/strong><\/a> regarding the use of the word \u201cYuppie\u201d culminated in a victory for Yuppie Gadgets in a Supreme Court ruling on 15 September.<\/p>\n<p>The fight started in November 2011, when Yuppie Gadgets received a legal letter, demanding it\u00a0to stop using the word \u201cYuppie\u201d in its\u00a0name.<\/p>\n<p>Yuppiechef had registered the name \u2018Yuppiechef\u2019 as a mark, and it felt Yuppie Gadgets was trading on its good name and was causing it harm.<\/p>\n<p>Yuppie Gadgets refused to stop using the word Yuppie, and the battle progressed to the Western Cape High Court \u2013 which ruled in favour of Yuppie Gadgets.<\/p>\n<p>Yuppiechef appealed the ruling, and the case was heard by the Supreme Court of Appeal (SCA)\u00a0in Bloemfontein on 1 September 2016.<\/p>\n<p>The SCA held that the two marks Yuppiechef and Yuppie Gadgets are not so similar that the use of Yuppie Gadgets was calculated to deceive or cause confusion among shoppers.<\/p>\n<p>It also held that the Yuppie Gadgets mark was being used for a business not related to the goods in respect of which Yuppiechef\u2019s mark was registered.<\/p>\n<p>The court further held that there was no evidence of blurring or the tarnishing\u00a0of the Yuppiechef mark.<\/p>\n<p>The Supreme Court of Appeal dismissed the appeal by Yuppiechef, with costs.
