{"id":138409,"date":"2016-09-28T14:14:57","date_gmt":"2016-09-28T12:14:57","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=138409"},"modified":"2016-09-28T14:14:57","modified_gmt":"2016-09-28T12:14:57","slug":"hlaudi-motsoeneng-not-going-anywhere-sabc-chair","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/media\/138409\/hlaudi-motsoeneng-not-going-anywhere-sabc-chair\/","title":{"rendered":"Hlaudi Motsoeneng not going anywhere: SABC chair"},"content":{"rendered":"<p>Former SABC chief operating officer (COO) Hlaudi Motsoeneng will remain an employee at the public broadcaster, SABC board chairperson Professor Mbulaheni Maguvhe said on Tuesday.<\/p>\n<p>\u201cMr Motsoeneng is still an employee. He would be going back to the position he held which is GE corporate affairs, and that is his previous position.\u201d<\/p>\n<p>Maguvhe said there was a perception in the media and among politicians that the SABC did not respect the courts and the Public Protector\u2019s office.<\/p>\n<p>\u201cToday is the day I want to put the record straight: That record is that there is a perception being created by opposition parties and media that SABC doesn\u2019t respect our legal institutions. We respect our legal institutions. Among them the PP\u2019s [Public Protector\u2019s] office and the courts.\u201d<\/p>\n<p>Maguvhe said the SABC followed recommendations from Public Protector Thuli Madonsela but the Democratic Alliance was dissatisfied with the outcome because it had its own agenda.<\/p>\n<p>\u201cWe adhered to that advice\u2026 Unfortunately when things do not go your way you think processes were not followed. After that disciplinary hearing, the DA says it was a white wash. When the DA win cases I don\u2019t cry and say it was a white wash.\u201d<\/p>\n<h3 class=\"my-4\">Instrumental to SABC agenda<\/h3>\n<p>He said the judgment by the Supreme Court of Appeal (SCA) stated that Motsoeneng could hold any position at the SABC including the position of COO if requirements are met.<\/p>\n<p>Acting group CEO James Aguma said: \u201cHe will be contributing to effecting the strategy of development. His role will be dealing with stakeholders\u2026 and also broad corporate affairs. Fundamentally his contribution is around raising our capital.\u201d<\/p>\n<p>Aguma praised Motsoeneng\u2019s contribution to the SABC while in the position of COO. He said Motsoeneng was instrumental in the SABC\u2019s transformation agenda.<\/p>\n<p>Maguvhe said when the position of COO is advertised Motsoeneng had a right to apply.<\/p>\n<p>He said he was concerned by interference from society and opposition parties.<\/p>\n<p>\u201cThey are the ones that are destabilising this organisation.\u201d<\/p>\n<h3 class=\"my-4\">\u2018Ordinary employee\u2019<\/h3>\n<p>Motsoeneng\u2019s application for leave to appeal against a ruling to set aside his appointment as the COO at the public broadcaster was dismissed by the SCA.<\/p>\n<p>Following the SCA ruling Motsoeneng reported for duty at the public broadcaster as an \u201cordinary employee\u201d.<\/p>\n<p>\u201cHe tended to his services this morning,\u201d his lawyer Zola Majavu told News24 at the time.<\/p>\n<p>This comes after the Public Protector found in a report released in February 2014 that Motsoeneng lied about his qualifications when he applied for the post of COO, that he hiked his salary from R1.5m to R2.4m in one year and purged senior staff.<\/p>\n<p>Despite these adverse findings Communications Minister Faith Muthambi confirmed his permanent appointment by the board.<\/p>\n<p>In November 2015, the Western Cape High Court found Motsoeneng\u2019s appointment was irrational and unlawful and set it aside. The DA brought the application.<\/p>\n<p>The DA got a court order forcing the SABC to hold a disciplinary hearing against him, but he was cleared of the charges in December 2015.<\/p>\n<p>On May 23 this year Judge Dennis Davis dismissed his application for leave to appeal.
