{"id":147905,"date":"2016-12-22T11:00:52","date_gmt":"2016-12-22T09:00:52","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=147905"},"modified":"2016-12-19T18:50:44","modified_gmt":"2016-12-19T16:50:44","slug":"how-to-spot-bribery-and-corruption-in-your-company","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/147905\/how-to-spot-bribery-and-corruption-in-your-company\/","title":{"rendered":"How to spot bribery and corruption in your company"},"content":{"rendered":"<p>LexisNexis Risk Management warns that companies have a responsibility to demonstrate their commitment towards preventing bribery as a matter of priority, or face being fined.<\/p>\n<p>Companies are required to mitigate financial penalties and reputational risks associated with bribery and corruption within their organisation and third-parties, with adequate preventative measures as per the requirements of the Bribery Act 2010.<\/p>\n<p>They must implement effective controls, measures and due diligence procedures by law or risk exposure, penalties and fines, said Rudi Kruger, GM at LexisNexis Risk Management.<\/p>\n<p>\u201cIt is necessary for them to identify potential incidents and to recognise them when they occur. However, many companies are ill-prepared,\u201d he said.<\/p>\n<p>\u201cFirst and foremost, it is important to note that bribery and corruption do not show up in plain sight. Companies are often unaware of their risk because they are not aware of the many forms in which bribery and corruption can occur. Daily business functions are the gateway to many of these activities and present serious risks if not controlled,\u201d said Kruger.<\/p>\n<p>He referenced the list of common corruption indicators, issued by Serious Fraud Office, the UK body which investigates and prosecutes serious and complex fraud.<\/p>\n<p>\u201cAlthough not all inclusive, the list of indicators goes a long way towards creating awareness on the many guises and opportunities for corruption to occur,\u201d he said.<\/p>\n<p>LexisNexis pointed to the following indicators when tackling potential bribery and corruption:<\/p>\n<ul>\n<li>Abnormal cash payments<\/li>\n<li>Abnormally high commission percentage being paid to a particular agency. This may be split into 2 accounts for the same agent often in different jurisdictions<\/li>\n<li>Abusing decision process or delegated powers in specific cases<\/li>\n<li>Agreeing contracts not favourable to the organisation either with terms or time period<\/li>\n<li>Avoidance of independent checks on tendering or contracting processes<\/li>\n<li>Bypassing normal tendering \/ contractors procedure<\/li>\n<li>Company procedures or guidelines not being followed<\/li>\n<li>Individual never takes time off even if ill, or holidays, or insists on dealing with specific contractors him\/ herself<\/li>\n<li>Invoices being agreed in excess of contract without reasonable cause<\/li>\n<li>Lavish gifts being received<\/li>\n<li>Making unexpected or illogical decisions accepting projects or contracts<\/li>\n<li>Missing documents or records regarding meetings or decisions<\/li>\n<li>Payments being made through 3rd party country, e.g. goods or services supplied to country A but payment is being made, usually to shell company in country B<\/li>\n<li>Pressure exerted for payments to be made urgently or ahead of schedule<\/li>\n<li>Private meetings with public contractors or companies hoping to tender for contracts<\/li>\n<li>Raising barriers around specific roles or departments which are key in the tendering \/ contracting process<\/li>\n<li>Unexplained preference for certain contractors during tendering period<\/li>\n<li>Unusually smooth process of cases where individual does not have the expected level of knowledge or expertise<\/li>\n<li>The payment of, or making funds available for high value expenses or school fees etc on behalf of others<\/li>\n<\/ul>\n<p>\u201cIn addition to these tell-tale signs, it\u2019s in your organisation\u2019s best interest to have in place comprehensive due diligence policies and procedures, which prove highly effective in mitigating risk as they provide you with the relevant intelligence.<\/p>\n<p>&#8220;All parties involved in your business, whether suppliers, partners, acquisition targets, contractors, resellers, grant applicants, other associates and in-house personnel, must be thoroughly vetted on an ongoing basis,\u201d said Kruger.<\/p>\n<p><strong>Read: <a href=\"https:\/\/businesstech.co.za\/news\/general\/137811\/anti-corruption-hotline-nabs-3570-officials\/\" target=\"_blank\">Anti-corruption hotline nabs 3,570 officials<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>LexisNexis Risk Management warns that companies have a responsibility to demonstrate their commitment towards preventing bribery as a matter of priority, or face being fined.<\/p>\n","protected":false},"author":10,"featured_media":99088,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872,11121],"tags":[26],"class_list":["post-147905","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","category-finance","tag-headline"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/147905","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=147905"}],"version-history":[{"count":1,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/147905\/revisions"}],"predecessor-version":[{"id":147907,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/147905\/revisions\/147907"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/99088"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=147905"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=147905"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=147905"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
