{"id":15636,"date":"2012-06-17T01:52:32","date_gmt":"2012-06-16T23:52:32","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=15636"},"modified":"2012-06-18T11:59:21","modified_gmt":"2012-06-18T09:59:21","slug":"facebook-to-pay-10m-to-settle-lawsuit","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/internet\/15636\/facebook-to-pay-10m-to-settle-lawsuit\/","title":{"rendered":"Facebook to pay $10m to settle lawsuit"},"content":{"rendered":"<p><a title=\"Facebook Inc\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1710-Facebook\">Facebook Inc<\/a> has agreed to pay $10 million to charity to settle a lawsuit that accused the site of violating users&#8217; rights to control the use of their own names, photographs and likenesses, according to court documents made public over the weekend.<\/p>\n<p>The lawsuit, brought by five Facebook members, alleged the social networking site violated California law by publicizing users&#8217; &#8220;likes&#8221; of certain advertisers on its &#8220;Sponsored Stories&#8221; feature without paying them or giving them a way to opt out, the documents said.<\/p>\n<p>A &#8220;Sponsored Story&#8221; is an advertisement that appears on a member&#8217;s Facebook page and generally consists of another friend&#8217;s name, profile picture and an assertion that the person &#8220;likes&#8221; the advertiser.<\/p>\n<p>The settlement was reached last month but made public this weekend. Facebook declined to comment on Saturday.<\/p>\n<p>The proposed class-action lawsuit, filed in federal court in San Jose, California, could have included nearly one of every three Americans, with billions of dollars in damages, according to previous court documents.<\/p>\n<p>In the lawsuit, Facebook Chief Executive <a title=\"Mark Zuckerberg\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/2451-Mark-Zuckerberg\">Mark Zuckerberg<\/a> was quoted as saying that a trusted referral was the &#8220;Holy Grail&#8221; of advertising.<\/p>\n<p>In addition, the lawsuit cited comments from Facebook chief operating officer <a title=\"Sheryl Sandberg\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/2169-Sheryl-Sandberg\">Sheryl Sandberg<\/a>, saying that the value of a &#8220;Sponsored Story&#8221; advertisement was at least twice and up to three times the value of a standard Facebook.com ad without a friend endorsement.<\/p>\n<p>U.S. District Judge Lucy Koh said the plaintiffs had shown economic injury could occur through Facebook&#8217;s use of their names, photographs and likenesses.<\/p>\n<p>&#8220;California has long recognized a right to protect one&#8217;s name and likeness against appropriation by others for their advantage,&#8221; Koh wrote.<\/p>\n<p>The settlement arrangement is known as a cy-pres settlement, meaning the settlement funds can go to charity.<\/p>\n<p>The case in U.S. District Court, Northern District of California is Angel Fraley et al., individually and on behalf of all others similarly situated vs. Facebook Inc., 11-cv-1726.<\/p>\n<p>Facebook shares closed at $30.01 on Friday, down 21 percent since the company&#8217;s initial public offering last month.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Facebook Inc has agreed to pay $10 million to charity to settle a lawsuit that accused the site of violating users&#8217; rights to control the use of their own names, photographs and likenesses, according to court documents made public over the weekend.<\/p>\n","protected":false},"author":7,"featured_media":785,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9882],"tags":[25,3193,45,371,217],"class_list":["post-15636","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-internet","tag-active","tag-charity","tag-facebook","tag-lawsuit","tag-settlement"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/15636","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/7"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=15636"}],"version-history":[{"count":4,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/15636\/revisions"}],"predecessor-version":[{"id":15703,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/15636\/revisions\/15703"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/785"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=15636"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=15636"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=15636"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
