{"id":165073,"date":"2017-03-20T19:00:37","date_gmt":"2017-03-20T17:00:37","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=165073"},"modified":"2017-03-20T17:22:30","modified_gmt":"2017-03-20T15:22:30","slug":"__trashed-28","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/wealth\/165073\/__trashed-28\/","title":{"rendered":"Big changes South African property-owners need to watch out for in 2017"},"content":{"rendered":"<p>There are a few significant changes on the cards for the South African property sector in 2017.<\/p>\n<p>While many of the proposals bring welcome amendments, legal analysts and real estate agents have noted\u00a0that some of the changes\u00a0coming into force this year won\u2019t necessarily be welcomed by all involved.<\/p>\n<p>Real-estate group, Just Property, and Cor Van Deventer, director of law firm\u00a0Greyvensteins lay out what property owners can expect:<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>The Expropriation Bill<\/strong><\/h3>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2017\/02\/Land-e1487938207370.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-160327 size-full\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2017\/02\/Land-e1487938207370.jpeg\" alt=\"\" width=\"604\" height=\"400\" \/><\/a><\/p>\n<p>Van Deventer has raised concerns about how the current definition of &#8220;property&#8221; in the bill is wide open to interpretation, in that it could include residential and commercial property, other movable property, as well as intangible property such as intellectual rights.<\/p>\n<p>&#8220;In addition, as compared to the Expropriation Act of 1975, which only makes provision for expropriation for public purposes, the new Bill goes a step further by including \u2018public purpose\u2019 and \u2018public interest\u2019 definitions,&#8221; said Van Deventer.<\/p>\n<p>&#8220;The new version of the Bill opens the door for expropriation of land for people who would like to undertake economic developments, such as low-income housing \u2012 in fact, it encourages it,\u201d said Van Deventer.<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>Office of the Valuer-General<\/strong><\/h3>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/06\/House-cost-buying-home.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-126065\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/06\/House-cost-buying-home.jpg\" alt=\"House cost buying home\" width=\"600\" height=\"403\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/06\/House-cost-buying-home.jpg 640w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2016\/06\/House-cost-buying-home-300x202.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>According to previous expropriation laws, when government expropriated land for roads, farmland or electricity usage, it was on the \u2018willing seller, able buyer\u2019 principle\u00a0&#8211; where, if owners did not really want to sell, they didn\u2019t have to, said\u00a0Van Deventer.<\/p>\n<p>With the establishment of the Office of the Valuer-General, the government can now expropriate property and pay out what the valuators have determined the price of the property to be. This amount will be will be based on market value.<\/p>\n<p>To be considered will also be the property\u2019s history of acquisition, current use and the purpose of expropriation.<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>The Promotion of Protection of Investment Bill<\/strong><\/h3>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2015\/07\/BEE-affirmative-action.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-94621 size-full\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2015\/07\/BEE-affirmative-action.jpg\" alt=\"\" width=\"600\" height=\"400\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2015\/07\/BEE-affirmative-action.jpg 600w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2015\/07\/BEE-affirmative-action-300x200.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>This bill stems from a court case in which foreign investors challenged the South African policy of Black Economic Empowerment (BEE) in international arbitration.<\/p>\n<p>\u201cAccording to this Act, government may take measures, in accordance with the Constitution and legislation, to redress historical inequalities, uphold the values and principles of the Constitution, foster economic development and protect the environment,\u201d said Van Deventer.<\/p>\n<p>\u201cIn its first draft, the Bill did not allow for international arbitration. It has tried to downplay concerns by stating that international arbitration may be resorted to, only if such arbitration is consented to by government and only once all domestic remedies have been exhausted.&#8221;<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>Bilateral investment treaties<\/strong><\/h3>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2012\/12\/stock-crash.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-28250 size-full\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2012\/12\/stock-crash.jpg\" alt=\"\" width=\"600\" height=\"400\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2012\/12\/stock-crash.jpg 600w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2012\/12\/stock-crash-300x200.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>\u201cThis Act makes provision that foreign investors will not be treated less favourably than South African investors, taking into account that the majority of BITs were entered into before our Constitution came into effect,&#8221; explained Van Deventer.<\/p>\n<p>The investment security provision also states that foreign investors will get the same level of security as domestic investors, but this is subject to the state\u2019s available resources and capacity.<\/p>\n<p>&#8220;It is clear that the Act protects South African interests above those of foreign companies.
