{"id":166369,"date":"2017-03-27T13:24:17","date_gmt":"2017-03-27T11:24:17","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=166369"},"modified":"2017-03-27T13:24:17","modified_gmt":"2017-03-27T11:24:17","slug":"guptas-file-paper-ordering-gordhan-to-be-present-at-court","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/166369\/guptas-file-paper-ordering-gordhan-to-be-present-at-court\/","title":{"rendered":"Guptas file paper ordering Gordhan to be present at court"},"content":{"rendered":"<p>Gupta-owned Saraha Computer filed papers in the North Gauteng High Court on Monday, disputing that the state attorney can represent Finance Minister Pravin Gordhan and seeking the minister to pay costs in his personal capacity.<\/p>\n<p>The latest affidavit filed on Monday follows news that President Jacob Zuma on Monday ordered Gordhan to return from London, where he had started an investor roadshow following his 2017 Budget.<\/p>\n<p>The rand buckled following the news, plunging from R12.31\/$ in morning trade to R12.63\/$ by 13:00 on Monday.<\/p>\n<p>Treasury explained on Saturday that Gordhan was not required to attend court as only his legal representative was required.<\/p>\n<p>However, Sahara on Monday disputed this in court papers, calling on the state attorney to \u201cestablish its authority to act\u201d.<\/p>\n<p>Various affidavits and letters regarding the argument of representation are contained in Monday&#8217;s affidavit.<\/p>\n<p>One reveals that the date of the initial court papers challenging Gordhan&#8217;s absence was dated 17 March 2017. Another reveals the state attorney response on 24 March 2016.<\/p>\n<p>Here, the attorney argues that Sahara was beyond the 10-day limit that a respondent has to counter such a move.
