{"id":172865,"date":"2017-05-02T09:31:53","date_gmt":"2017-05-02T07:31:53","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=172865"},"modified":"2017-05-02T09:31:53","modified_gmt":"2017-05-02T07:31:53","slug":"anti-corruption-bill-could-face-constitutional-court-challenge-report","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/172865\/anti-corruption-bill-could-face-constitutional-court-challenge-report\/","title":{"rendered":"Anti-corruption bill could face Constitutional Court challenge: report"},"content":{"rendered":"<p>The Progressive Professionals Forum (PPF) has promised to appeal the newly approved Financial Intelligence Centre Amendment (FICA) bill in the Constitution Court as it believes the law gives undue powers to South Africa&#8217;s banking sector, according to a report by <strong><a href=\"http:\/\/www.news24.com\/SouthAfrica\/News\/ppf-vows-to-fight-fica-in-concourt-20170501\" target=\"_blank\" rel=\"noopener noreferrer\">News24<\/a><\/strong>.<\/p>\n<p>While the organisation supports the bills&#8217; \u00a0higher aims to combat white-collar crime in South Africa, it must do so without discarding the rights of our members, said\u00a0PPF spokesperson Luther Lebelo.<\/p>\n<p>As a result he confirmed that the PPF\u00a0would be writing to finance minister Malusi Gigaba to postpone the bill, failing which the organisation will be appealing the introduction of the bill in the Constitutional Court.<\/p>\n<p>&#8220;We have a number of concerns with the Bill. One is that it abolishes the current council, the counter money laundering council on which several parties, including the Reserve Bank, sits. Inspectors will now be accountable to the banks,&#8221; said Lebelo.<\/p>\n<p>&#8220;It gives banks the power to make the determination on suspicious transactions.
