Solidarity and Afriforum have confirmed that they have filed court papers against the South African Rugby Union (SARU), Cricket South Africa (CSA), Athletics South Africa (ASA) and Netball South Africa (NSA).<\/p>\n
According to the groups, the agreed upon quotas do not conform to local and international legislation and agreed upon norms.<\/p>\n
\u201cWe request an order that the court declare that the Transformation Charter insofar as it pertains to demographic profiling as invalid, and of no force and effect,” said Johan Kruger, Deputy Chief Executive of Solidarity.<\/p>\n
“We further request that the court declare the agreements between the parties insofar as it pertains to quotas, as invalid and of no force and effect, and that sporting bodies are interdicted from applying quotas in determining team selection at a national, provincial, club or school level.”<\/p>\n
This was echoed by\u00a0Kallie Kriel, Chief Executive of AfriForum, who said that that merits should be the only criterion in the compilation of sports teams.<\/p>\n
\u201cThe enforcement of racial quotas and political interference in South African sport directly violates the rules and regulations of international sports bodies. That is why AfriForum is going to send a delegation to several international sports bodies within the next months,” said Kriel.<\/p>\n
Solidarity originally made the new quotas public knowledge in March 2017 after it announced\u00a0that it would be making an application under the\u00a0Promotion of Access to Information Act (Paia), to compel the Ministry to disclose information with regard to its transformation targets.<\/p>\n
This follows an April 2016 declaration by\u00a0Sports Minister, Fikile Mbalula, who noted that in the event of a federation failing to meet the\u00a0transformation targets, he would consider scrapping national recognition, major tournaments and the opportunity to earn colours.<\/p>\n
