{"id":183647,"date":"2017-07-05T08:02:15","date_gmt":"2017-07-05T06:02:15","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=183647"},"modified":"2017-07-05T08:05:26","modified_gmt":"2017-07-05T06:05:26","slug":"parliament-opens-controversial-cyber-crime-bill-to-public-comment","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/technology\/183647\/parliament-opens-controversial-cyber-crime-bill-to-public-comment\/","title":{"rendered":"Parliament opens controversial cyber crime Bill to public comment"},"content":{"rendered":"<p>The Portfolio Committee on Justice and Correctional Services has invited stakeholders and interested persons to submit written submissions on the\u00a0<a href=\"https:\/\/www.parliament.gov.za\/storage\/app\/media\/Docs\/bill\/616565_1.pdf\" target=\"_blank\" rel=\"noopener\">Cybercrimes and Cybersecurity Bill.<\/a><\/p>\n<p>The bill\u00a0\u00a0has been introduced to bring South Africa in line with other countries\u2019 cyber laws as well as the ever-growing threat of cyber crime.<\/p>\n<p>It also plans to introduce a number of <a href=\"https:\/\/businesstech.co.za\/news\/internet\/151687\/you-could-face-3-years-in-jail-if-you-send-these-types-messages-over-facebook-or-whatsapp-even-if-theyre-private\/\" target=\"_blank\" rel=\"noopener\">controversial <\/a>new laws including possible jail-time for any \u2018malicious\u2019 electronic communication.<\/p>\n<p>This includes possible\u00a0jail time of up to 3 years and\/or a fine if a message is found to:<\/p>\n<ul>\n<li>It incites the causing of any damage to any property belonging to, or violence against, a person or a group of persons;<\/li>\n<li>It intimidates, encourages or harasses a person to harm himself or herself or any other person;<\/li>\n<li>It is inherently false in nature and it is aimed at causing mental, psychological, physical or economic harm to a specific person or a group of persons;<\/li>\n<li>It is intimate in nature (aka nudity), and is distributed without the consent of the person involved.<\/li>\n<\/ul>\n<p>Other purposes of the new\u00a0Cybercrimes and Cybersecurity Amendment Bill is to:<\/p>\n<ul>\n<li>Create offences and impose penalties which have a bearing on cyber crime;<\/li>\n<li>Criminalise the distribution of data messages which is harmful and to provide for interim protection orders;<\/li>\n<li>Further regulate jurisdiction in respect of cyber crimes;<\/li>\n<li>Further regulate the powers to investigate cyber crimes;<\/li>\n<li>Further regulate aspects relating to mutual assistance in respect of the investigation of cyber crime;<\/li>\n<li>Provide for the establishment of a 24\/7 Point of Contact;<\/li>\n<li>Further provide for the proof of certain facts by affidavit;<\/li>\n<li>Impose obligations on electronic communications service providers and financial institutions to assist in the investigation of cyber crimes and to report cyber crimes;<\/li>\n<li>Provide for the establishment of structures to promote cyber security and capacity building;<\/li>\n<li>Regulate the identification and declaration of critical information infrastructures and measures to protect critical information infrastructures;<\/li>\n<li>Provide that the Executive may enter into agreements with foreign States to promote cyber security;<\/li>\n<li>Delete and amend provisions of certain laws;
