{"id":194642,"date":"2017-08-25T15:37:18","date_gmt":"2017-08-25T13:37:18","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=194642"},"modified":"2017-08-25T15:38:01","modified_gmt":"2017-08-25T13:38:01","slug":"6-ways-government-wants-to-stop-dstvs-monopoly-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/media\/194642\/6-ways-government-wants-to-stop-dstvs-monopoly-in-south-africa\/","title":{"rendered":"6 ways government wants to end DStv&#8217;s monopoly in South Africa"},"content":{"rendered":"<p>The\u00a0Independent Communications Authority of South Africa\u00a0(Icasa)\u00a0has published its inquiry into subscription-based television broadcasting services.<\/p>\n<p>The objective of the inquiry is ultimately to determine whether there are competition issues in the sector and whether Icasa needs to step in and impose new pro-competitive conditions.<\/p>\n<p>The inquiry was based on a number of questionnaires sent out to relevant stakeholders and forms part of an initial analysis which Icasa has opened for comment.<\/p>\n<p>In addition to traditional TV-based subscription services such as DStv, other streaming services such as Netflix and Showmax also form part of the inquiry.<\/p>\n<p>Speaking specifically on paid-for television subscriptions, the regulator said it was concerned about the uncompetitive nature in which it had first-access to certain shows, its exclusive rights to sporting events (cricket, rugby and soccer) and the high barriers of entry into the paid-for space and whether certain companies have a monopoly.<\/p>\n<p>The six pro-competitive conditions it proposed to enforce on these monopolistic companies include:<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>Shortening exclusive contracts<\/strong><\/h3>\n<p>One of the effects of long-term contracts in the market for the acquisition of premium content is input foreclosure, the inquiry said.<\/p>\n<p>&#8220;Whoever wins an exclusive contract forecloses competitors from accessing the content.&#8221;<\/p>\n<p>&#8220;As a way of limiting the harm to competition created by long-term contracts, their duration can be reduced.&#8221;<\/p>\n<p>Using current European standards as a benchmark, Icasa proposes that contracts may not be concluded for longer than five years.<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>Unbundling<\/strong><\/h3>\n<p>Again using Europe as an example, the inquiry proposes unbundling sports rights to more than one buyer.<\/p>\n<p>These rights would then be sold under the following conditions:<\/p>\n<ul>\n<li>they must be sold on an open tender<\/li>\n<li>they must be &#8220;unbundled&#8221; allowing more than one buyer<\/li>\n<li>there can be no exclusivity (Icasa cites a norm of three years)<\/li>\n<li>no automatic renewal of contracts<\/li>\n<\/ul>\n<hr \/>\n<h3 class=\"my-4\"><strong>Impose rights splitting<\/strong><\/h3>\n<p>Similar to the unbundling sports rights, Icasa proposes that a rights owner split their content rights and sell them to more than one broadcaster.<\/p>\n<p>While this could hit consumers&#8217; pockets by making them subscribe to multiple services, it will benefit them in the long run as it provides greater competition in the market, the inquiry said.<\/p>\n<hr \/>\n<h3 class=\"my-4\"><strong>Impose wholesale-must-offer<\/strong><\/h3>\n<p>Citing the case of Sky in the UK, Icasa proposes introducing a\u00a0wholesale-must-offer on sports channels, which requires an operator to sell sporting content to other distributors at regulated prices.<\/p>\n<p>While the UK regulator has subsequently removed the requirement &#8211;
