{"id":200704,"date":"2017-09-26T08:12:24","date_gmt":"2017-09-26T06:12:24","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=200704"},"modified":"2017-09-26T08:12:24","modified_gmt":"2017-09-26T06:12:24","slug":"fears-that-government-has-captured-sa-universities","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/200704\/fears-that-government-has-captured-sa-universities\/","title":{"rendered":"Fears that government has &#8220;captured&#8221; SA universities"},"content":{"rendered":"<p>Legal experts and academics have expressed concerns over new laws which they believe will undermine the independence of South Africa&#8217;s universities.<\/p>\n<p>The 2016 Higher Education Amendment\u00a0<strong><a href=\"https:\/\/docs.google.com\/viewer?url=https%3A%2F%2Fwww.gov.za%2Fsites%2Fdefault%2Ffiles%2F40548_Act9of2016HighEducationAmendmentAct2016.pdf\" target=\"_blank\" rel=\"noopener\">Act<\/a><\/strong> became\u00a0largely operational last week, reports <strong><a href=\"http:\/\/legalbrief.co.za\/diary\/legalbrief-today\/policy-watch\/legislation-controversial-higher-education-act-in-force\/\" target=\"_blank\" rel=\"noopener\">Legalbrief&#8217;s<\/a><\/strong> Pam Saxby.<\/p>\n<p>The Act empowers the minister of higher education to determine transformation goals for the sector, along with oversight mechanisms to ensure that they are achieved.<\/p>\n<p>These include the &#8220;articulation and recognition&#8221; of prior learning frameworks across the education, as well as the ability to amend the criteria for recognition as a university, university college, or higher education.<\/p>\n<p>&#8220;Less widely reported in the media are provisions in the new statute,&#8221; said Saxby.<\/p>\n<p>&#8220;(These) strengthen the minister\u2019s powers to intervene when a tertiary institution has been found to be \u2018underperforming\u2019; and facilitating \u2018stricter oversight\u2019 of government subsidy spending.&#8221;<\/p>\n<p>These include the power to\u00a0change the processes, procedures and mandates of universities and other higher education institutions.<\/p>\n<p>It also empowers the minister to withhold funding in cases where the minister deems it necessary.<\/p>\n<p>Speaking on the <strong><a href=\"https:\/\/www.iol.co.za\/news\/politics\/controversial-higher-education-amendment-bill-passed-2025767\" target=\"_blank\" rel=\"noopener\">passing <\/a><\/strong>of the bill last year,\u00a0Democratic Alliance MP Belinda Bozzoli said the party opposed several clauses in the amendment bill &#8211; specifically those that gave the minister wider powers to intervene in university business.<\/p>\n<p>\u201cToday, with the failure of existing methods of fixing the dysfunctional universities, the minister seeks to expand his powers,&#8221; said Bozzoli.<\/p>\n<p>&#8220;The new bill has a clause which means that he will now only need to have \u2018reason to believe\u2019 &#8211; rather than concrete proof &#8211; that intervention is necessary. It will become easier to suspend university independence, and more difficult to challenge such a decision in court.<\/p>\n<p>\u201cThe bill also proposes to give the minister new powers to issue directives to the [university] council for up to five years after the administrator leaves. This extends the period of suspension of university autonomy from two years to seven.
