{"id":205574,"date":"2017-10-20T18:30:37","date_gmt":"2017-10-20T16:30:37","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=205574"},"modified":"2017-10-20T13:54:30","modified_gmt":"2017-10-20T11:54:30","slug":"snitch-on-your-co-workers-or-end-up-fired-yourself-warn-experts","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/205574\/snitch-on-your-co-workers-or-end-up-fired-yourself-warn-experts\/","title":{"rendered":"&#8220;Snitch&#8221; on your co-workers or end up fired yourself, warn experts"},"content":{"rendered":"<p>Where employees possess information that would enable an employer to identify wrongdoers and those employees fail to come forward, they are guilty of &#8220;derivative misconduct&#8221;.<\/p>\n<p>This is according to\u00a0Hugo Pienaar\u00a0and\u00a0Nomlayo Mabhena of legal firm Cliffe Dekker Hofmeyr, who explained that\u00a0such conduct violates the trust upon which the employment relationship is founded.<\/p>\n<p>&#8220;This concept was\u00a0confirmed in a recent case\u00a0where the Labour Court held that an employee bound implicitly by a duty of good faith towards the employer breaches that duty by remaining silent about knowledge possessed by the employee regarding the business interests of the employer being improperly undermined,&#8221; said\u00a0Cliffe Dekker Hofmeyr.<\/p>\n<p>&#8220;The court further held, that on general principle, a breach of the duty of good faith can justify dismissal.&#8221;<\/p>\n<p><strong>Group punishment\u00a0<\/strong><\/p>\n<p>According to the attorneys, in recent times derivative misconduct has commonly been applied in the context of strikes where there is a breach of picketing rules and an employer wishes to take action against the employees who fail to report breaches by their fellow employees of the picketing rules.<\/p>\n<p>The question that then arises is how an employer proceeds with an inquiry involving a large number of employees as it would be\u00a0impractical to hold, for example, thirty individual inquiries.<\/p>\n<p>As a result &#8220;collective inquiries&#8221; have become increasingly common, they said.<\/p>\n<p>&#8220;The rationale for collective disciplinary enquiries is based on two principles, said\u00a0Cliffe Dekker Hofmeyr.<\/p>\n<p>&#8220;Firstly, that employees have acted collectively and associated themselves with an act of misconduct and therefore, they are charged collectively.<\/p>\n<p>&#8220;It is sufficient that a particular employee merely witnessed the unlawful conduct.<\/p>\n<p>&#8220;Secondly, if the employee witnesses the conduct but does not participate in the intimidation, and fails to disclose this information to the employer, he\/she may in addition be charged in the collective inquiry, based on derivative misconduct.&#8221;<\/p>\n<hr \/>\n<p><strong>Read:\u00a0<a href=\"https:\/\/businesstech.co.za\/news\/technology\/204442\/5-jobs-you-could-be-doing-in-2025-which-dont-currently-exist\/\" target=\"_blank\" rel=\"noopener\">5 jobs you could be doing in 2025 \u2013 which don\u2019t currently exist<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>There is no longer &#8220;safety in numbers&#8221; at the workplace according to South African legal experts.<\/p>\n","protected":false},"author":10,"featured_media":157647,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[1523,26],"class_list":["post-205574","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-cliffe-dekker-hofmeyr","tag-headline"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/205574","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=205574"}],"version-history":[{"count":12,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/205574\/revisions"}],"predecessor-version":[{"id":206609,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/205574\/revisions\/206609"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/157647"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=205574"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=205574"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=205574"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
