{"id":21919,"date":"2012-09-11T16:14:56","date_gmt":"2012-09-11T14:14:56","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=21919"},"modified":"2012-09-12T13:40:38","modified_gmt":"2012-09-12T11:40:38","slug":"cell-c-ads-trash-mtn-asa-ruling","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/telecommunications\/21919\/cell-c-ads-trash-mtn-asa-ruling\/","title":{"rendered":"Cell C ads &#8220;trash&#8221; MTN: ASA ruling"},"content":{"rendered":"<p>The Advertising Standards Authority of South Africa (<a title=\"ASA\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1814-ASA-Advertising-Standards-Authority-of-South-Africa\">ASA<\/a>) has ruled in favour of <a title=\"MTN\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1640-MTN-Group\">MTN<\/a>\u2019s complaints against radio and TV advertisements by <a title=\"Cell C\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1641-Cell-C\">Cell C<\/a> that are said to poke fun at the yellow network\u2019s \u201cMTN Zone\u201d product.<\/p>\n<p>According to the <a href=\"http:\/\/asasa.org.za\/ResultDetail.aspx?Ruling=6237\" target=\"_blank\">ASA ruling<\/a>, Cell C aired a commercial on TV that opens with one man saying to another \u201cDamn! I\u2019m out of the zone.\u201d<\/p>\n<p>MTN\u2019s lawyers argued that in the context of the rest of the commercial, Cell C was disparaging <a title=\"MTN Zone\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/4812-MTN-Zone\">MTN Zone<\/a> as no other mobile network operator in SA uses the term \u201czone\u201d in its advertisements.<\/p>\n<p>Cell C\u2019s lawyers responded that it is permissible in terms of the ASA code to have a \u201cdig\u201d at competitors as a secondary communication in an advertisement. They went on to argue that the word \u201czone\u201d was used within the ordinary meaning of the word.<\/p>\n<p>In its ruling on the matter, the ASA pointed out that the code does not allow advertisements to attack, discredit or disparage other products, services, advertisers or advertisements directly or indirectly.<\/p>\n<p>\u201cComparisons highlighting a weakness in an industry or product will not necessarily be regarded as disparaging when the information is factual and in the public interest,\u201d the ASA explained. \u201cIt further states that the ASA shall take cognisance of what it considers to be the intention of the advertiser.\u201d<\/p>\n<p><iframe loading=\"lazy\" src=\"http:\/\/www.youtube.com\/embed\/G4GBNpdbVZU\" frameborder=\"0\" width=\"600\" height=\"340\"><\/iframe><\/p>\n<p>The ASA upheld MTN\u2019s complaint, ruling as follows:<\/p>\n<blockquote><p>The commercial adds no value to the MTN Zone product, and goes beyond merely introducing a new alternative to existing pre-paid cell phone offers. The commercial seeks to promote Cell C\u2019s new 99c for Real product by devaluing and \u201ctrashing\u201d MTN\u2019s \u201cZone\u201d product. The gesture of the cell phone being emphatically slapped out of Man One\u2019s hand by Man Two, together the words \u201cSo if you\u2019re not on nine nine\u2026 you\u2019re wasting airtime\u201d, communicate that people should stop using MTN Zone and should opt for Cell C\u2019s 99c for Real product. This constitutes disparagement.<\/p><\/blockquote>\n<p>It is worth noting that MTN\u2019s decision to lodge competitor complaints with the ASA came after they ran ads that hit back at Cell C.<\/p>\n<p>The radio ad embedded below clearly has MTN poking fun at the \u201cPapa\u201d character in Cell C\u2019s new advertisements.<\/p>\n<p><iframe loading=\"lazy\" src=\"http:\/\/www.youtube.com\/embed\/6QNiXOMubuA\" frameborder=\"0\" width=\"600\" height=\"338\"><\/iframe><\/p>\n<p>MTN lodged two competitor complaints, one for a TV ad and one for a radio ad, asking in both cases that sanctions be imposed on Cell C.<\/p>\n<p>In its ruling against a Cell C radio commercial, the ASA delivered a similar <a href=\"http:\/\/asasa.org.za\/ResultDetail.aspx?Ruling=6236 \">rebuke<\/a> as its ruling on the TV ad, and spelled out the procedure to be followed before deciding on sanctions:<\/p>\n<blockquote><p>The complainant submitted that the radio commercial was specifically targeted at its products with a clear intent to disparage, and accordingly asked for additional sanctions to be imposed on the respondent.
