{"id":244861,"date":"2018-05-16T10:03:03","date_gmt":"2018-05-16T08:03:03","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=244861"},"modified":"2018-05-16T10:03:03","modified_gmt":"2018-05-16T08:03:03","slug":"this-is-when-your-boss-can-fire-you-for-what-you-say-on-facebook-and-twitter","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/244861\/this-is-when-your-boss-can-fire-you-for-what-you-say-on-facebook-and-twitter\/","title":{"rendered":"This is when your boss can fire you for what you say on Facebook and Twitter"},"content":{"rendered":"<p>While most South African employees have a general idea of what they can and can&#8217;t get away with in the privacy of their own homes, the nature of social media means that these issues often bring their employers under the spotlight.<\/p>\n<p>This was the case in a recent Commission for Conciliation, Mediation and Arbitration (CCMA) dispute, which dealt with the dismissal of an employee who posted alleged racist comments on Facebook.<\/p>\n<p>According to Jacques van Wyk, director and labour specialist at Werksmans Attorneys,\u00a0the employee faced two charges in the case.<\/p>\n<p>The first charge concerned the <strong>use of abusive and racist language<\/strong> and\/or grossly inappropriate conduct resulting from a racist and\/or derogatory statement the employee made on Facebook, where he stated: \u201cKill the Boer, we need to kill these\u201d.<\/p>\n<p>The second charge concerned the employee <strong>bringing the company&#8217;s name into disrepute<\/strong>, as a client complained about the Facebook comment to the employer. At the hearing, the employee was found guilty of the first charge and dismissed for misconduct.<\/p>\n<p>&#8220;The employee argued that his dismissal was substantively unfair, as he was not guilty of the offence for which he was dismissed,&#8221; said van Wyk<\/p>\n<p>&#8220;He argued further that if he was guilty, the sanction of dismissal was inappropriate, as he was not aware of the fact that he may not post comments on Facebook. The employee also challenged the procedural fairness of his dismissal.&#8221;<\/p>\n<p>According to van Wyk, the Commissioner held that the dismissal was procedurally fair (the employer followed the correct steps before dismissal).<\/p>\n<p>Turning his attention as to whether the employee\u2019s dismissal was substantively fair, he acknowledged two previous cases:<\/p>\n<ul>\n<li><strong>SA Equity Workers Association on behalf of Bester v Rustenburg Platinum Mine and Another (2017)<\/strong> &#8211; where the court held that race descriptors are neutral and it is only by locating them in a \u2018pejorative\u2019 context that their use should be condemned as racist. The Commissioner held that the employee\u2019s Facebook post was placed in a pejorative context.<\/li>\n<\/ul>\n<ul>\n<li><strong>AfriForum and another v Malema and another (2011)<\/strong> &#8211;\u00a0 where the court held that the meaning of alleged racist or derogatory words is what the reasonable person would ascribe it to be.<\/li>\n<\/ul>\n<p>&#8220;The Commissioner held that in this instance, the meaning of \u2018kill the boer\u2019 can largely and objectively be interpreted by a reasonable person to mean: kill white people.<\/p>\n<p>&#8220;Accordingly he found that the employee\u2019s Facebook post was racist, and that the applicant was guilty of the charge for which he was dismissed,&#8221;\u00a0said van Wyk.<\/p>\n<p>Based on previous cases the Commissioner also noted that it made no difference to the case that the employee was not at work when he posted the comments or that the comment was not directed towards a fellow employee, said van Wyk.<\/p>\n<p><strong>Importance<\/strong><\/p>\n<p>Highlighting the importance of the this case,\u00a0van Wyk said that there are now two considerations when\u00a0determining whether to take disciplinary action against an employee where the employee allegedly makes racist\/or derogatory statements outside of work.<\/p>\n<p>&#8220;The first question is whether the statement has a <strong>pejorative context<\/strong> that a reasonable person would ascribe as being racist and\/or derogatory,&#8221; he said.<\/p>\n<p>&#8220;The second question is whether the employee\u2019s conduct has a <strong>negative bearing on his\/her continued suitability for employment<\/strong>.&#8221;<\/p>\n<hr \/>\n<p><strong>Read:\u00a0<a href=\"https:\/\/businesstech.co.za\/news\/business\/236837\/expect-more-south-africans-to-be-fired-for-their-facebook-statuses-legal-expert\/\" rel=\"bookmark\">Expect more South Africans to be fired for their Facebook comments: expert<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The rise of social media means that even comments made away from work could cost you your job. <\/p>\n","protected":false},"author":10,"featured_media":241575,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[26,5114],"class_list":["post-244861","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-headline","tag-werksmans"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/244861","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=244861"}],"version-history":[{"count":10,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/244861\/revisions"}],"predecessor-version":[{"id":244885,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/244861\/revisions\/244885"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/241575"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=244861"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=244861"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=244861"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
