{"id":290084,"date":"2018-12-10T07:53:34","date_gmt":"2018-12-10T05:53:34","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=290084"},"modified":"2018-12-10T07:53:34","modified_gmt":"2018-12-10T05:53:34","slug":"major-judgement-to-help-protect-south-africans-in-debt-report","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/finance\/290084\/major-judgement-to-help-protect-south-africans-in-debt-report\/","title":{"rendered":"Major judgement to help protect South Africans in debt: report"},"content":{"rendered":"<p>A new Supreme Court of Appeal judgement will bring welcome relief to indebted South Africans.<\/p>\n<p>According to a report by <strong><a href=\"https:\/\/www.groundup.org.za\/article\/court-ruling-provides-some-relief-borrowers\/\" target=\"_blank\" rel=\"noopener\">GroundUp<\/a><\/strong>, the ruling upheld that borrowers may not pay more than\u00a03% interest a month on a\u00a0second short-term loan taken out in a 12 month period.<\/p>\n<p>The regulations were originally\u00a0introduced by the National Credit Regulator and the Department of Trade and Industry.<\/p>\n<p>However, these regulations were challenged by\u00a0\u00a0Micro Finance South Africa (MFSA) which argued it would reduce credit availability to those most in need.<\/p>\n<p>The High Court originally ruled in favour of MFSA but this was overturned on appeal by a full bench of the court.<\/p>\n<p>That decision was also appealed by MFSA at the Supreme Court of Appeal, which has now ruled in favour of the NCR and DTI.
