{"id":295934,"date":"2019-01-29T13:56:25","date_gmt":"2019-01-29T11:56:25","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=295934"},"modified":"2019-01-29T13:56:25","modified_gmt":"2019-01-29T11:56:25","slug":"national-minimum-wage-inspections-will-start-next-month","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/295934\/national-minimum-wage-inspections-will-start-next-month\/","title":{"rendered":"National minimum wage inspections will start next month"},"content":{"rendered":"<p>The Department of Labour&#8217;s Inspection and Enforcement Services (IES) branch says it will\u00a0embark on a national blitz campaign in February to assess levels of compliance with labour laws &#8211; particularly the newly-introduced National Minimum Wage.<\/p>\n<p>The department said that 1,392 inspectors are ready to monitor compliance with the National Minimum Wage Act.<\/p>\n<p>According to the deputy director-general of the IES, Aggy Moiloa,\u00a0the department will be using its Basic Conditions of Employment Act (BCEA) specialist inspectors to enforce the act.<\/p>\n<p>The blitz campaign would focus on\u00a0advocacy, inspections and enforcement. The wholesale and retail sectors have been identified as problematic areas, and will be of particular focus.<\/p>\n<p>The National Minimum Wage came into effect on 1 January 2019. The wage is R20, the minimum rate at which workers should earn per hour, with a few exceptions.\u00a0Agricultural\/farm workers have a minimum set at R18 per hour, and domestic workers at R15 per hour.<\/p>\n<p>Moiloa said the department was aware of the burden imposed by NMW to the\u00a0Commission for Conciliation Mediation and Arbitration&#8217;s (CCMA) resources and was ready to assist.<\/p>\n<p>She said aggrieved workers on issues of NMW can take their complaints to the Department\u2019s Labour Centres, or directly report to the CCMA.<\/p>\n<p>The CCMA said that as of Friday (January 25) it has received 405 referrals on the newly-implemented NMW, contributing a 3.2% rise in its case load.<\/p>\n<p>As part of its readiness the labour department already had the following in place:<\/p>\n<ul>\n<li>A case management systems has been developed;<\/li>\n<li>CCMA has conducted training on their system in order for the inspectorate to refer cases; and<\/li>\n<li>Inspectors have been trained to monitor compliance with the NMW Act.<\/li>\n<\/ul>\n<p><strong>Non-compliance<\/strong><\/p>\n<p>Employers who are found to not be in compliance with the new laws will face penalties &#8211; specifically, a fine.<\/p>\n<p>The fine is calculated <strong>per employee<\/strong> as the greater amount of <strong>double the value of the underpayment<\/strong> or <strong>double the employee\u2019s monthly wage<\/strong>.<\/p>\n<hr \/>\n<p><strong>Read:\u00a0<a href=\"https:\/\/businesstech.co.za\/news\/business\/292750\/national-minimum-wage-everything-you-need-to-know\/\" rel=\"bookmark\">National minimum wage \u2013 everything you need to know<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Department of Labour&#8217;s Inspection and Enforcement Services will\u00a0embark on a national blitz campaign in February to assess levels of compliance with labour laws &#8211; particularly the newly-introduced National Minimum Wage.<\/p>\n","protected":false},"author":10,"featured_media":144519,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[26],"class_list":["post-295934","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-headline"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/295934","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=295934"}],"version-history":[{"count":3,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/295934\/revisions"}],"predecessor-version":[{"id":295948,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/295934\/revisions\/295948"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/144519"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=295934"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=295934"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=295934"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
