{"id":32045,"date":"2013-02-20T16:12:38","date_gmt":"2013-02-20T14:12:38","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=32045"},"modified":"2015-05-05T08:45:16","modified_gmt":"2015-05-05T06:45:16","slug":"beware-defamatory-oscar-tweets","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/32045\/beware-defamatory-oscar-tweets\/","title":{"rendered":"Beware defamatory Oscar tweets"},"content":{"rendered":"<p>A legal expert has warned users of social network Twitter that comments against Olympic athlete Oscar Pistorius may potentially lead to a defamation claim down the line.<\/p>\n<p>Pistorius is currently in the dock facing charges that he shot and murdered his girlfriend, Reeva Steenkamp on Valentines Day.<\/p>\n<p>The story has captivated people both locally, and internationally, given the athlete&#8217;s profile.<\/p>\n<p>His story has also led to thousands of Twitter users to make comments, jokes, and even judgements on his guilt or innocence &#8211; before his case was even heard in court earlier this week.<\/p>\n<p>\u201cThe Oscar Pistorius case has enthralled South Africans who are torn between supporting their hero and their disappointment at seemingly being let down by a South African icon,\u201d said legal expert and founder of web.tech.law, Paul Jacobson on his website.<\/p>\n<p>Web.tech.law is a specialised Web and digital media legal and compliance services firm.<\/p>\n<p>\u201cWhile our Bill of rights gives us the right to express our opinions, our rights are not absolute and, in the context of defamation, the defamed person\u2019s right to dignity often holds sway unless there are clear public policy reasons to allow the comments to stand,\u201d Jacobson said.<\/p>\n<p>He pointed out that Pistorius is yet to be found guilty and is therefore, still under law, innocent.<\/p>\n<p>\u201cDrawing conclusions about Pistorius\u2019 guilt and publishing those conclusions online can lead to a defamation claim down the line,&#8221;
