{"id":335019,"date":"2019-08-16T10:04:10","date_gmt":"2019-08-16T08:04:10","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=335019"},"modified":"2019-08-16T13:41:44","modified_gmt":"2019-08-16T11:41:44","slug":"south-africas-new-demerit-system-is-now-law","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/motoring\/335019\/south-africas-new-demerit-system-is-now-law\/","title":{"rendered":"South Africa&#8217;s new driving demerit system is now law"},"content":{"rendered":"<p>President Cyril Ramaphosa <a href=\"https:\/\/www.parliament.gov.za\/storage\/app\/media\/Docs\/atc\/e212b59a-f1aa-48ce-ac74-ea1bbec8f0da.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>has signed<\/strong><\/a> the controversial Administrative Adjudication of Road Traffic Offences (Aarto) Bill into law.<\/p>\n<p>The legislation is perhaps known for its proposed introduction of a demerit system for South African drivers, and it is expected to fundamentally change driving in the country.<\/p>\n<p>Some of the biggest changes include:<\/p>\n<ul>\n<li>A new demerit system will be introduced. Depending on the severity of the offence, 1-6 points are allocated for offences. If an infringer has more than 12 points, it will result in the disqualification of the driving licence and three suspensions result in its cancellation;<\/li>\n<\/ul>\n<ul>\n<li>Failing to pay traffic fines can lead to a block on obtaining driving and vehicle licences and an administrative fee \u2013 in addition to other penalties;<\/li>\n<\/ul>\n<ul>\n<li>Where documents previously had to be delivered by registered mail through the post office, in terms of the amendment, authorities will now also be able to serve documents electronically and can send reminders via WhatsApp and SMS;<\/li>\n<\/ul>\n<ul>\n<li>The establishment of a new Appeals Tribunal which will preside over issues that are raised under the new bill.<\/li>\n<\/ul>\n<p>It is not yet clear when the new law will officially come into effect, or whether parts of the bill will be introduced retrospectively.<\/p>\n<p><strong>Controversy\u00a0<\/strong><\/p>\n<p>In June, the Automobile Association penned an open letter to new transport minister, Fikile Mbalula, pointing to a number of areas that need urgent attention \u2013 including the new demerit system.<\/p>\n<p>\u201cThe AA believes in a points-based system, and the original concept is good. It will punish the bad, warn the middle, and leave the good,\u201d it said.<\/p>\n<p>The association warned however, that the system in its current form \u2013 if implemented \u2013 will not in any way reshape the country\u2019s roads to become safer \u2013 one of the original benefits.<\/p>\n<p>\u201cInstead, this system seems to have morphed into a better way for revenue collection by authorities, with no regard for safety or proper application of laws.
