{"id":339643,"date":"2019-09-09T14:28:48","date_gmt":"2019-09-09T12:28:48","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=339643"},"modified":"2019-09-09T14:30:11","modified_gmt":"2019-09-09T12:30:11","slug":"mtn-hit-with-r5-million-fine-for-hiking-prices-without-sufficient-notice","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/mobile\/339643\/mtn-hit-with-r5-million-fine-for-hiking-prices-without-sufficient-notice\/","title":{"rendered":"MTN hit with R5 million fine for hiking prices without sufficient notice"},"content":{"rendered":"<p>MTN has been\u00a0<strong><a href=\"https:\/\/www.icasa.org.za\/complaints-and-compliance-committee\/cca-v-mtn-04-march-2019-3102019\" target=\"_blank\" rel=\"noopener noreferrer\">issued a fine<\/a><\/strong>\u00a0by ICASA\u2019s Complaints and Compliance Committee (CCC) for not observing the required notice period when increasing the price of its 1GB WhatsApp data bundle.<\/p>\n<p>The fine comprises a total of R5 million, of which R2 million is suspended for three years following the date of the ruling.<\/p>\n<p>MTN was found to have contravened regulation 9 of the standard terms and conditions by not notifying ICASA at least seven days before changing the price of its monthly 1GB WhatsApp data bundle to R30.<\/p>\n<p>\u201cThe contravention, even considered within its background was, accordingly, a serious contravention,\u201d the CCC stated.<\/p>\n<p>\u201cICASA obviously, by regulation, places a high premium on compliance with the seven working days\u2019 notice. Only two working days\u2019 notice was given.\u201d<\/p>\n<p>However, the committee did acknowledge that MTN faced extenuating circumstances in changing the price before the notice period had lapsed.<\/p>\n<p>MTN explained that it was forced to hike the price of the bundle to avoid a potential disaster.<\/p>\n<p>\u201cThe earlier implementation of the price increase was forced by technical risks whose eventual occurrence could have been catastrophic,\u201d the ruling stated.<\/p>\n<p>\u201cThe volume of traffic on the WhatsApp bundle was unprecedented, and thus it presented novel challenges to MTN.\u201d<\/p>\n<p><strong>3G demand<\/strong><\/p>\n<p>MTN South Africa Executive for Corporate Affairs Jacqui O\u2019Sullivan stated that the price change was implemented due to the unprecedented demand on the operator\u2019s 3G network.<\/p>\n<p>\u201cIn April 2018, MTN launched its social bundles and introduced a monthly WhatsApp bundle of 1GB for just R10,\u201d O\u2019Sullivan said.<\/p>\n<p>\u201cThe public\u2019s response was exceptional.
