{"id":34969,"date":"2013-04-05T12:56:57","date_gmt":"2013-04-05T10:56:57","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=34969"},"modified":"2013-04-05T13:12:42","modified_gmt":"2013-04-05T11:12:42","slug":"industry-questions-icasa-over-iburst-action","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/34969\/industry-questions-icasa-over-iburst-action\/","title":{"rendered":"Industry questions Icasa over iBurst action"},"content":{"rendered":"<p>Prominent industry players have questioned the decision of the Independent Communications Authority of South Africa (Icasa) to take down iBurst\u2019s network by confiscating core network equipment.<\/p>\n<p>iBurst\u2019s network went down on Wednesday morning after Icasa\u00a0confiscated some of the company\u2019s core network equipment hosted in the MTN Gallo Manor data centre.<\/p>\n<p>Thousands of iBurst and Broadlink customers were left without any services, harming their businesses and causing massive reputation damage to all parties involved \u2013 including Broadlink and iBurst resellers.<\/p>\n<p>To date Icasa\u00a0has been mum on the issue. The fact that the regulator is not willing to explain its actions is causing further uncertainty in an industry which is in dire need of stability and certainty from Icasa\u00a0and the Department of Communications.<\/p>\n<p>The matter is further complicated by apparent conflict within Icasa\u00a0regarding the action against WBS\/iBurst.<\/p>\n<p>TechCentral reported that Icasa\u00a0chairman Stephen Mncube instructed councillors to hold off against \u201cany and all actions against WBS\u2026 pending the strategy and further investigation into the matter being finalised by [Icasa attorneys] Bowman Gilfillan\u201d.<\/p>\n<p>According to the report, Icasa\u00a0councillor Joseph Lebooa was not happy, arguing that \u201cThe sanction on [Icasa] employees not to act on WBS is illegal and unwarranted and constitutes a violation of the laws of the land.\u201d<\/p>\n<p>MyBroadband asked the regulator about its decision to take down iBurst\u2019s network, but again the regulator did not explain its actions.<\/p>\n<p>&nbsp;<\/p>\n<div id=\"attachment_34978\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a  data-lightbox=\"post-image\" href=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/04\/Stephen-Mncube.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-34978\" class=\"size-full wp-image-34978\" alt=\"Stephen Mncube\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/04\/Stephen-Mncube.jpg\" width=\"600\" height=\"399\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/04\/Stephen-Mncube.jpg 600w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/04\/Stephen-Mncube-300x199.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-34978\" class=\"wp-caption-text\">Stephen Mncube<\/p><\/div>\n<p>One prominent industry player, who asked not to be named, said that it is regrettable that the regulator seems to want to make a point by taking down a large telecoms network, while it is not doing much to boost the industry through spectrum allocation or local loop unbundling.<\/p>\n<p>He said that disputes regarding license fees are not uncommon, partly because of problems within the regulator.<\/p>\n<p>Icasa\u2019s decision to confiscate core network equipment, which seems to be based on such a dispute, is creating concern in the industry.<\/p>\n<p>Mike Brown, managing director of Broadlink which uses iBurst\u2019s network to offer connectivity services, said that Icasa\u2019s actions have caused damage to both his business and his clients.<\/p>\n<p>Brown said that he had no notice from Icasa\u00a0that they are planning to take down a network which he uses.
