{"id":351857,"date":"2019-11-07T12:57:08","date_gmt":"2019-11-07T10:57:08","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=351857"},"modified":"2019-11-07T12:57:08","modified_gmt":"2019-11-07T10:57:08","slug":"how-south-africas-new-controversial-internet-censorship-laws-will-impact-you","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/internet\/351857\/how-south-africas-new-controversial-internet-censorship-laws-will-impact-you\/","title":{"rendered":"How South Africa&#8217;s new controversial &#8216;internet censorship&#8217; laws will impact you"},"content":{"rendered":"<p>President Cyril Ramaphosa signed off on the controversial Films and Publications Amendment Act in October 2019.<\/p>\n<p>Described in the media as the &#8220;internet censorship bill&#8221;, the Act will now officially come into operation on a future date to be declared by the President, says Peter Grealy of law firm Webber Wentzel.<\/p>\n<p>Grealy said that among other changes, the Act\u00a0introduces significant changes to our law, including the regulation of harmful content and hate speech.<\/p>\n<p>It also regulates commercial distributors of content (including people who distribute content online for commercial purposes) as well as non-commercial distributors (who distribute content for their own private use).<\/p>\n<p>The Act also places new obligations on internet service providers (ISPs) to remove and report certain content or be subject to a fine, he said.<\/p>\n<p><strong>How you will be impacted<\/strong><\/p>\n<p>The Act regulates content uploaded by social media users, bloggers and influencers, Grealy said.<\/p>\n<p>&#8220;There are criminal penalties for distributing content that amounts to propaganda for war, incites violence or which advocates hatred against a person or an identifiable group or which amounts to child pornography.<\/p>\n<p>&#8220;In a welcome step, the Act criminalises the intentional distribution of private sexual photographs\/films without the prior consent of the subject of such photographs and\/or films,&#8221; he said.<\/p>\n<p>Grealy said that any Internet Service Provider (ISP)\u00a0who has knowledge that its services are being used for the distribution or hosting of content that incites imminent violence; propaganda for war; advocates hatred against a person or an identifiable group or amounts to child pornography must:<\/p>\n<ul>\n<li>Immediately remove the content; and<\/li>\n<li>Furnish the Film and Publications Board, or a member of the South African Police Services, with information of the identity of the person who published the prohibited \u200bcontent.<\/li>\n<\/ul>\n<p>&#8220;A failure to do so could result in a fine not exceeding R50,000 and\/or imprisonment for a period not exceeding six months,&#8221; he said.<\/p>\n<hr \/>\n<p><strong>Read: <a href=\"https:\/\/businesstech.co.za\/news\/banking\/350995\/new-law-pushes-south-african-banks-to-cut-back-on-lending\/\" target=\"_blank\" rel=\"noopener noreferrer\">New law pushes South African banks to cut back on lending<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Cyril Ramaphosa signed off on the controversial Films and Publications Amendment Act in October 2019.<\/p>\n","protected":false},"author":10,"featured_media":245533,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9882],"tags":[26,9455],"class_list":["post-351857","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-internet","tag-headline","tag-webber-wentzel"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/351857","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=351857"}],"version-history":[{"count":6,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/351857\/revisions"}],"predecessor-version":[{"id":352163,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/351857\/revisions\/352163"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/245533"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=351857"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=351857"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=351857"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
