{"id":374780,"date":"2020-02-18T08:30:20","date_gmt":"2020-02-18T06:30:20","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=374780"},"modified":"2020-02-18T08:30:20","modified_gmt":"2020-02-18T06:30:20","slug":"this-is-how-south-africas-planned-car-regulations-will-impact-your-insurance","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/motoring\/374780\/this-is-how-south-africas-planned-car-regulations-will-impact-your-insurance\/","title":{"rendered":"This is how South Africa&#8217;s planned car regulations will impact your insurance"},"content":{"rendered":"<p>The Competition Commission has\u00a0<strong><a href=\"https:\/\/businesstech.co.za\/news\/motoring\/374630\/new-regulations-that-every-south-african-driver-should-know-about\/\" target=\"_blank\" rel=\"noopener noreferrer\">gazetted\u00a0<\/a><\/strong>draft guidelines for the automotive aftermarket industry in South Africa, promising a big shake-up for car service and warranty plans in South Africa.<\/p>\n<p>Currently, the majority of owners of new cars in South Africa are locked into using a vehicle manufacturer\u2019s service centres, repair shops and parts in \u2018embedded\u2019 motor and service plans.<\/p>\n<p>However, under the new guidelines, consumers will no longer be compelled to conduct in-warranty service, maintenance or repair work only at approved dealers or approved service providers.<\/p>\n<p>The guidelines also outline planned changes for car insurance in South Africa. These changes include:<\/p>\n<ul>\n<li><span class=\"a\">Insurers<strong> mus<span class=\"l7\">t approve any s<span class=\"l9\">ervice p<span class=\"l8\">roviders\u00a0<span class=\"l6\">that meet their standards and<\/span><\/span><\/span><\/span><\/strong><\/span><span class=\"a\"><strong>\u00a0specifications<\/strong>, to undertake service and maintenance work, motor-<\/span><span class=\"a\">body repairs, non-structural repairs and mechanical repairs on vehicles<\/span><span class=\"a\"> during the warranty period;<\/span><\/li>\n<\/ul>\n<ul>\n<li><span class=\"a\">Insurers <strong>may <span class=\"l7\">not prohib<span class=\"l6\">it approved s<span class=\"l8\">ervice providers or approved d<\/span><\/span><\/span><\/strong><\/span><span class=\"a\"><strong>ealers<\/strong> from carrying out service and maintenance work, motor-body repairs<\/span><span class=\"a\">, non-structural repairs and mechanical repairs on vehicles <\/span><span class=\"a\">of other brands;<\/span><\/li>\n<\/ul>\n<ul>\n<li><span class=\"a\">Insurers <strong>mus<\/strong><span class=\"l6\"><strong>t advise consumers, in\u00a0<\/strong><span class=\"l8\"><strong>clear and explicit terms<\/strong>,\u00a0<span class=\"l9\">that they have<\/span><\/span><\/span><\/span><span class=\"a\">\u00a0a right to have the service and maintenance work, motor-body repairs<\/span><span class=\"a\">, non-structural repairs and mechanical repairs of their vehicles undertaken<\/span><span class=\"a\"> by any service providers of their choice;<\/span><\/li>\n<\/ul>\n<ul>\n<li><span class=\"a\">Insurers <strong>must <\/strong><span class=\"l10\"><strong>publish a\u00a0<\/strong><span class=\"l9\"><strong>list of\u00a0<\/strong><span class=\"l8\"><strong>all their approved s<\/strong><span class=\"l7\"><strong>ervice p<\/strong><span class=\"l6\"><strong>roviders<\/strong> on their<\/span><\/span><\/span><\/span><\/span><\/span><span class=\"a\"> websites and\/or other suitable media;<\/span><\/li>\n<\/ul>\n<ul>\n<li><span class=\"a\">Insurers m<span class=\"l6\">ust offer consumers\u00a0a choice\u00a0of approved\u00a0<span class=\"l7\">repairers\u00a0within their geographic<\/span><\/span><\/span><span class=\"a\"> area from which they can select to repair their vehicles. <\/span><span class=\"a\">They are also <strong>prohibited from <\/strong><span class=\"l6\"><strong>appointing an exclusiv<\/strong><span class=\"l7\"><strong>e service provider<\/strong> within a designated<\/span><\/span> geographic area.<\/span><\/li>\n<\/ul>\n<p>The deadline for submission of comments on the guidelines is 16 March 2020.<\/p>\n<p>A finalised set of guidelines will ultimately be implemented as part of the Competition Act and will give authorities the power to pursue anti-competitive behaviour through enforcement.<\/p>\n<hr \/>\n<p><strong>Read: <a
