The high court interdict against the Independent Communications Authority of South Africa (ICASA), forcing the regulator to return the iBurst equipment it confiscated on 3 April 2013, was set to expire on 25 May 2013. However, this date has been extended to 29 June 2013.<\/p>\n
In April 2013, ICASA seized WBS [and hence iBurst] radio communication equipment at six Gauteng sites, taking down a large part of iBurst\u2019s and Broadlink\u2019s networks.<\/p>\n
This followed ICASA\u2019s hard-line approach to non-compliance with regard to the collection of outstanding radio frequency licence fees in October 2012.<\/p>\n
ICASA\u2019s actions left thousands of consumers and businesses without connectivity, which lead to WBS\u2019s successful application for a high court interdict against ICASA to return its equipment.<\/p>\n
The regulator returned iBurst\u2019s network equipment, and the network was restored to its original state.<\/p>\n
This court interdict was set to expire tomorrow (25 May 2013), but this date has been extended to 29 June 2013.<\/p>\n
\u201cThe interim relief granted in paragraph 2 of the order by Judge Vally on 5 April 2013 is extended and will lapse on 29 June 2013,\u201d a South Gauteng court order states.<\/p>\n
\u201cThe court order provides a brief description of the proceedings and the time frames for the exchange of pleadings between the parties (WBS and ICASA), however the matter will be proceeding as scheduled on 29 May 2013,\u201d said ICASA.<\/p>\n
WBS\/iBurst was asked for comment, but the company did not respond by the time of publication.<\/p>\n
