{"id":391159,"date":"2020-04-21T08:23:43","date_gmt":"2020-04-21T06:23:43","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=391159"},"modified":"2020-04-21T08:23:43","modified_gmt":"2020-04-21T06:23:43","slug":"new-regulations-as-south-africa-waits-for-updated-lockdown-plan","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/391159\/new-regulations-as-south-africa-waits-for-updated-lockdown-plan\/","title":{"rendered":"New regulations as South Africa waits for updated lockdown plan"},"content":{"rendered":"<p>Government has published a number of new and revised regulations as the country waits to hear its plan around lifting the five-week-long countrywide lockdown.<\/p>\n<p>President Cyril Ramaphosa met with his <strong><a href=\"https:\/\/mailchi.mp\/presidency.gov.za\/presidesk-mon-20apr20\" target=\"_blank\" rel=\"noopener noreferrer\">cabinet<\/a> <\/strong>on Monday (20 April) to finalise a set of measures to respond to the impact of the lockdown as well as plans for the country once the lockdown is lifted.<\/p>\n<p>While cabinet is expected to make a statement on its new plan on Tuesday, a number of government departments have continued to introduce new lockdown regulations\u00a0 &#8211;\u00a0 with some proving to be more controversial than others.<\/p>\n<p>Below are some of the new regulations announced over the last week.<\/p>\n<hr \/>\n<p><strong>Ban on &#8216;hot foods&#8217;\u00a0<\/strong><\/p>\n<p>Arguably the most controversial new change was published on Monday and prohibited a ban on the sale of all &#8216;hot foods&#8217; by essential retailers.<\/p>\n<p>The directive was effectively only a line long and included no other changes, giving the impression that the government has gone out of its way to introduce this specific ban.<\/p>\n<p>There is still no official explanation as to why the government has banned the sale of such food. Business group Sakeliga has indicated that it will challenge the new amendment, slamming the &#8216;arbitrary&#8217; introduction of regulations by the government.<\/p>\n<p>\u201cIf something is not done immediately, even entirely legal, essential businesses may be unsure of their status,&#8221; it said.<\/p>\n<p>&#8220;We would like to see a more nuanced, consistent and thoughtful approach from government.<\/p>\n<p>&#8220;It is important to note that South Africa\u2019s restrictions on these businesses are far more extreme than what is warranted by the vast majority of international expertise \u2013 including recommendations by bodies such as the World Health Organisation.\u201d<\/p>\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-style: normal; font-variant: normal; font-weight: normal; font-size: 14px; line-height: normal; font-size-adjust: none; font-stretch: normal; -x-system-font: none; display: block;\"><a style=\"text-decoration: underline;\" title=\"View COGTA Regulations 20 April on Scribd\" href=\"https:\/\/www.scribd.com\/document\/457318338\/COGTA-Regulations-20-April#from_embed\">COGTA Regulations 20 April<\/a> by <a style=\"text-decoration: underline;\" title=\"View BusinessTech's profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/413742166\/BusinessTech#from_embed\">BusinessTech<\/a> on Scribd<\/p>\n<p><iframe loading=\"lazy\" class=\"scribd_iframe_embed\" title=\"COGTA Regulations 20 April\" src=\"https:\/\/www.scribd.com\/embeds\/457318338\/content?start_page=1&amp;view_mode=scroll&amp;access_key=key-023gLuwbsFl6rk5uomLo\" width=\"100%\" height=\"600\" frameborder=\"0\" scrolling=\"no\" data-auto-height=\"true\" data-aspect-ratio=\"0.7080062794348508\"><\/iframe><\/p>\n<hr \/>\n<p><strong>List of essential goods expanded<\/strong><\/p>\n<p>Higher education minister Blade Nzimande has added a number of items to the list of essential goods which may be sold during the country&#8217;s lockdown so that the country&#8217;s higher education institutions such as universities and colleges can continue to function.<\/p>\n<p>Nzimande said that the transport of these goods between suppliers and higher education institutions as well as between institutions and individuals will now be declared an essential service.<\/p>\n<p>The list of items include:<\/p>\n<ul>\n<li>Information and Communication Technology devices (such as desktops, laptops, modems and other devices) for education purposes;<\/li>\n<li>Gasses, liquids and chemicals used in the preservation of biological samples and maintenance of equipment and machinery;<\/li>\n<li>Animal feed for laboratory and farm animals.<\/li>\n<\/ul>\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-style: normal; font-variant: normal; font-weight: normal; font-size: 14px; line-height: normal; font-size-adjust: none; font-stretch: normal; -x-system-font: none; display: block;\"><a style=\"text-decoration: underline;\" title=\"View Higher Education Regulation 20 April on Scribd\" href=\"https:\/\/www.scribd.com\/document\/457326555\/Higher-Education-Regulation-20-April#from_embed\">Higher Education Regulation&#8230;<\/a> by <a style=\"text-decoration: underline;\" title=\"View BusinessTech's profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/413742166\/BusinessTech#from_embed\">BusinessTech<\/a> on Scribd<\/p>\n<p><iframe loading=\"lazy\" class=\"scribd_iframe_embed\" title=\"Higher Education Regulation 20 April\" src=\"https:\/\/www.scribd.com\/embeds\/457326555\/content?start_page=1&amp;view_mode=scroll&amp;access_key=key-OuGZjg0nRNjCbmGTeJo7\" width=\"100%\" height=\"600\" frameborder=\"0\" scrolling=\"no\" data-auto-height=\"true\" data-aspect-ratio=\"0.7080062794348508\"><\/iframe><\/p>\n<hr \/>\n<p><strong>Petty criminals to be released?\u00a0<\/strong><\/p>\n<p>The Department of Correctional facilities has indicated that it is considering the release of criminals who have committed &#8216;petty offences&#8217; in a bid to avoid overcrowding in the country&#8217;s prisons.<\/p>\n<p>The country&#8217;s lockdown <strong><a href=\"https:\/\/businesstech.co.za\/news\/government\/386761\/new-crime-and-justice-lockdown-regulations-south-africans-should-know-about\/\" target=\"_blank\" rel=\"noopener noreferrer\">regulations<\/a> <\/strong>allow for &#8216;an accused person arrested for a petty offence must be released and warned to appear in court on a future date&#8217;. However, it appears that government has not utilised this provision up until this point.<\/p>\n<p>Speaking to <strong><a href=\"https:\/\/www.timeslive.co.za\/politics\/2020-04-20-inmates-who-cant-pay-bail-for-petty-crimes-could-be-released-on-warning\/\" target=\"_blank\" rel=\"noopener noreferrer\">TimesLive<\/a><\/strong>, a correctional services spokesperson said that overcrowding in the country&#8217;s prisons continues to pose a challenge to practising physical distancing to limit the impact of the coronavirus.<\/p>\n<p>&#8220;Inmates detained for minor offences with a bail option (they cannot afford) are being considered for placement on warning by courts.
