{"id":399763,"date":"2020-05-20T11:05:27","date_gmt":"2020-05-20T09:05:27","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=399763"},"modified":"2020-05-20T11:05:50","modified_gmt":"2020-05-20T09:05:50","slug":"how-businesses-ripped-off-south-africans-during-the-lockdown","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/399763\/how-businesses-ripped-off-south-africans-during-the-lockdown\/","title":{"rendered":"How businesses ripped off South Africans during the lockdown"},"content":{"rendered":"<p>The Competition Commission has published new data showing how some businesses have used South Africa&#8217;s lockdown to hike the price of goods.<\/p>\n<p>Presenting to parliament on Tuesday (19 May), the Commission said that has since the beginning of the national disaster on 17 March 2020, it has received a total of 1,354 complaints and tip-offs from the public.<\/p>\n<p>The complaints are investigated in terms of Section 8 of the Competition Act, which prohibit excessive pricing.<\/p>\n<p>&#8220;An excessive price refers to a price for a good or service which bears no reasonable relation to the economic value of that good or service, or is higher than the value of that good or service,&#8221; the Commission said.<\/p>\n<p>&#8220;It is prohibited for a dominant firm to charge an excessive price to the detriment of consumers. The threshold for dominance is turnover of over R5 million and the possession of market power.&#8221;<\/p>\n<p>The Commission said that most of the complaints relate to the allegations that retailers, traders, suppliers and pharmacies are charging excessive prices for Covid-19 related products including:<\/p>\n<ul>\n<li>Masks and sanitisers;<\/li>\n<li>Protective gear (PPEs), and;<\/li>\n<li>Certain essential goods and basic food items.<\/li>\n<\/ul>\n<p>From the cases that it screened, the Commission said that it noticed the following trends:<\/p>\n<ul>\n<li>Retailers, traders or suppliers increased prices and margins in response to increases in: Public demand and panic buying; Input costs and cost of imports; Rand depreciation and\/or supply disruptions because of Covid-19.<\/li>\n<\/ul>\n<ul>\n<li>Some firms have increased prices despite no significant increase in input costs (price gouging).<\/li>\n<\/ul>\n<ul>\n<li>\u00a0There was an increase in\u00a0 &#8216;opportunistic trading&#8217; through various platforms, such as existing retail channels, direct sales to the public or online platforms of items that were not previously traded with huge mark-ups.<\/li>\n<\/ul>\n<p><strong>Complaints\u00a0<\/strong><\/p>\n<p>The Competition Commission said that the largest proportion of complaints about excessive pricing were from Gauteng (43%).<\/p>\n<p>By comparison, KZN (14%), the North West (13%) and the Western Cape (12%) received comparatively fewer cases.<\/p>\n<p>The largest portion of complaints around excessive pricing was about the high cost of basic food products (265 complaints).<\/p>\n<p>Other complaints focused on the price of masks (164 complaints) and the cost of sanitisers\/wipes (125 complaints).<\/p>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Complaints.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-399775 aligncenter\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Complaints.png\" alt=\"\" width=\"937\" height=\"676\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Complaints.png 937w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Complaints-300x216.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Complaints-768x554.png 768w\" sizes=\"auto, (max-width: 937px) 100vw, 937px\" \/><\/a><\/p>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Excessive-2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-399785 aligncenter\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Excessive-2.png\" alt=\"\" width=\"887\" height=\"652\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Excessive-2.png 887w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Excessive-2-300x221.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Excessive-2-768x565.png 768w\" sizes=\"auto, (max-width: 887px) 100vw, 887px\" \/><\/a><\/p>\n<p>While the Competition Commission did not provide details on all of its cases, it did highlight some of the most egregious companies which it dealt with.<\/p>\n<p>It should be noted that some of these cases are still ongoing and that the case may be found in favour of the firm.<\/p>\n<ul>\n<li><strong>Babelegi Workwear Overall Manufacturers &amp; Industrial Supplies<\/strong>:\u00a0 Price increases of facial masks from R41 per box up to R500 per box which account for markups in excess of 500%;<\/li>\n<\/ul>\n<ul>\n<li><strong> Dis-Chem Group<\/strong>: Price increases of surgical face masks increased in excess of between 43% and 261%;<\/li>\n<\/ul>\n<ul>\n<li><strong>Hennox<\/strong>: Price increases of Filtering Face Piece 1 (FFP1) masks by up to 969.07%;<\/li>\n<\/ul>\n<ul>\n<li><strong>Sicuro Safety<\/strong>: Price increases of FFP1 masks by up to 956.07%.<\/li>\n<\/ul>\n<p>The firms could face penalties of up to 10% of annual turnover.<\/p>\n<p><strong>Punishment<\/strong><\/p>\n<p>The Competiton Commission said it also achieved a number of settlements and consent orders with several respondent firms, with the following broad undertakings:<\/p>\n<ul>\n<li>Corrective action to prices\/margins \u2013 reduction of up to 20%;<\/li>\n<li>Penalty or donation that bears some relationship to the excess profits earned to charity organizations, old age homes and the Solidarity Fund, and;<\/li>\n<li>Penalty that exceeds excess profits earned.<\/li>\n<\/ul>\n<p>To date, a total of 35 firms are in various stages of settlement, the Competition Commission said.<\/p>\n<p>It added that 13 settlements have been confirmed by the Competition Tribunal through consent orders,.<\/p>\n<p>The total value of the settlements finalised is equal to R12,854,694.<\/p>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Competition-Commission.png\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-399795 aligncenter\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Competition-Commission.png\" alt=\"\" width=\"886\" height=\"424\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Competition-Commission.png 924w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Competition-Commission-300x144.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Competition-Commission-768x367.png 768w\" sizes=\"auto, (max-width: 886px) 100vw, 886px\" \/><\/a><\/p>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Funds.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-399799 aligncenter\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Funds.png\" alt=\"\" width=\"887\" height=\"445\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Funds.png 887w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Funds-300x151.png 300w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2020\/05\/Funds-768x385.png 768w\" sizes=\"auto, (max-width: 887px) 100vw, 887px\" \/><\/a><\/p>\n<p><strong>Food prices\u00a0<\/strong><\/p>\n<p>The Commission said it is also monitoring food market pricing to understand retail level inflation &amp;
