This can lead many to make poor financial decisions such as skipping a vehicle instalment payment, leading to repossession by the bank.<\/p>\n<p>Personal finance website JustMoney investigates what happens when a lender wants to repossess your vehicle \u2012 and how you can help prevent this scenario.<\/p>\n<p>Jaco Hamman, an attorney at Hahn and Hahn, notes that when you miss your first payment, the lender will notify you that you have a certain number of days to catch up on your payment. Failure to pay thereafter entitles the lender to cancel its finance agreement with you.<\/p>\n<p>Hamman said the lender must first institute action against you, such as the issuing of a summons.<\/p>\n<p>\u201cThe summons will be delivered to your address via a sheriff. If you don\u2019t defend the summons, then the lender can obtain judgement and a warrant of execution. It\u2019s only through this warrant of execution that a sheriff can repossess your car,\u201d said Hamman.<\/p>\n<p>However, the lender is not entitledd to bully and lie to you, alleging that your vehicle can be repossessed without following due process.<\/p>\n<hr \/>\n<p><strong>Be careful<\/strong><\/p>\n<p>Hamman said there are many lenders who use debt collectors to repossess your car. The debt collectors will arrive at your address with a form telling you that you need to sign the form and give back the vehicle.<\/p>\n<p>\u201cThis form is actually a voluntary surrender form in which you state that you voluntarily surrender your vehicle. There\u2019s no obligation whatsoever on you to sign such a form and return the vehicle to the lender or its debt collector,\u201d said Hamman.<\/p>\n<p>\u201cBe sure that it\u2019s a legitimate repossession through the sheriff. If not, you\u2019re within your rights to refuse to hand back the vehicle,\u201d he said.<\/p>\n<hr \/>\n<p><strong>Voluntary surrender<\/strong><\/p>\n<p>Section 127 of the National Credit Act gives provision for consumers to voluntarily surrender their car.<\/p>\n<p>If you find that you\u2019re no longer able to keep up with your car payments, you can hand it back to the lender. You can do this by writing a letter of notice informing the lender that you want to terminate your contract.<\/p>\n<p>After five business days of handing in the letter, you must return the vehicle or arrange with your creditor how the car will be returned.<\/p>\n<p>Your creditor will then give you written notice setting out the estimated value of the car.<\/p>\n<p>You\u2019ll have 10 days to decide whether you still want the car or not. If you\u2019re no longer interested, the lender will sell it. If there\u2019s a shortfall in the sale, you\u2019ll still be liable to pay for the vehicle.<\/p>\n<p>However, if there\u2019s a surplus, the lender will credit your account.<\/p>\n<hr \/>\n<p><strong>You can avoid repossession<\/strong><\/p>\n<p>Hamman said you can avoid repossession by making a payment arrangement with the lender and if that fails, you must determine if you qualify for debt counselling.<\/p>\n<p>He said that once you\u2019re under debt counselling the only way to change your counselling status is to pay off all your short-term credit agreements.<\/p>\n<p>Your debt counselling status will reflect on your credit record and you won&#8217;t be able to incur any further debt, and this could also have an effect on your ability to rent property.<\/p>\n<hr \/>\n<p><strong>Can you adjust your car instalments?<\/strong><\/p>\n<p>As with any credit agreement, you can ask your creditor to adjust your car instalments until you\u2019re back on your feet.<\/p>\n<p>The creditor will reduce your instalments and extend the term of your loan. You can also ask your creditor to defer your payments, but this isn\u2019t advisable as the interest won\u2019t stop accumulating.<\/p>\n<p>It could land you in more debt, but it will provide temporary relief.<\/p>\n<p>\u201cTaking out a car loan is a three to five year commitment that ideally needs careful planning before you take on this responsibility,\u201d said JustMoney commercial manager Sarah Nicholson.<\/p>\n<p>\u201cGiven the economic downturn and rising unemployment, do your homework, shop around and negotiate before signing on the bottom line if you are in the market for a vehicle.\u201d<\/p>\n<hr \/>\n<p><strong>Read: <a href=\"https:\/\/businesstech.co.za\/news\/motoring\/412559\/south-africans-are-buying-these-second-hand-cars-with-price-and-mileage\/\" target=\"_blank\" rel=\"noopener noreferrer\">South Africans are buying these second-hand cars \u2013 with price and mileage<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Consumers are struggling under the current recessionary environment in South Africa.
