{"id":416105,"date":"2020-07-14T13:21:30","date_gmt":"2020-07-14T11:21:30","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=416105"},"modified":"2020-07-14T13:23:20","modified_gmt":"2020-07-14T11:23:20","slug":"eskom-may-have-broken-law-with-tender-that-ballooned-over-12000","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/energy\/416105\/eskom-may-have-broken-law-with-tender-that-ballooned-over-12000\/","title":{"rendered":"Eskom may have broken the law with tender that ballooned over 12,000%"},"content":{"rendered":"<p>Eskom Holdings may have broken tender laws in concluding a 2005 agreement with Black &amp; Veatch Corp. that increased more than 100-fold in cost, according to a probe of the contract commissioned by the South African utility.<\/p>\n<p>A former High Court judge who conducted the investigation, which cleared Eskom Chief Operating Officer Jan Oberholzer of corruption, questioned why the cost of the continuing contract increased to more than R14 billion ($833 million) from an initial R114 million (a 12,180% increase).<\/p>\n<p>He said the deal should be investigated.<\/p>\n<p>\u201cThis contract, and the allocation of funds, may not have met the requirements of the tender law in that it was an open tender, subject to abuse without finite limitations,\u201d Nazeer Cassim, the former judge, said in his report on the probe, which hasn\u2019t been released publicly.<\/p>\n<p>\u201cIt may be prudent to investigate the particularities justifying the increase\u201d to assess whether there was \u201cimproper conduct,\u201d he said.<\/p>\n<p>Black &amp; Veatch, a Kansas-based engineering firm, denied any wrongdoing.
