{"id":41981,"date":"2013-07-15T11:00:17","date_gmt":"2013-07-15T09:00:17","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=41981"},"modified":"2013-07-15T11:50:08","modified_gmt":"2013-07-15T09:50:08","slug":"d-day-looms-for-telkom","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/telecommunications\/41981\/d-day-looms-for-telkom\/","title":{"rendered":"D-day looms for Telkom"},"content":{"rendered":"<p><a title=\"Telkom\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1637-Telkom\">Telkom<\/a> is set to go\u00a0in front\u00a0of the\u00a0Competition Tribunal this week, on Wednesday (17 July) as it seeks clarity over terms reached in a R200 million\u00a0settlement for abusing its dominance in the broadband market.<\/p>\n<p>The settlement agreement addresses various complaints lodged against Telkom from 2005 to 2007 by the <a title=\"Internet Service Providers Association\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/2493-ISPA-Internet-Service-Providers-Association\">Internet Service Providers Association<\/a> and others.<\/p>\n<p>The settlement package, announced in June, includes:<\/p>\n<ul>\n<li>An admission of guilt;<\/li>\n<li>Financial penalty of R200 million;<\/li>\n<li>Functional separation between Telkom\u2019s retail and wholesale divisions along with a transparent transfer pricing programme to ensure non-discriminatory service provision by Telkom to its retail division and ISPs;<\/li>\n<li>Effective monitoring arrangements of its future conduct;<\/li>\n<li>And wholesale and retail pricing commitments for the next five years estimated to yield R875m savings to customers.<\/li>\n<\/ul>\n<p>The agreement is subject to confirmation by the Competition Tribunal.<\/p>\n<p>Telkom however, will seek to gain\u00a0clarification\u00a0on a number of points within the original agreement, most notably where the agreement relates to a &#8220;functional separation&#8221;
