{"id":45858,"date":"2013-09-12T15:51:55","date_gmt":"2013-09-12T13:51:55","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=45858"},"modified":"2013-09-12T15:57:19","modified_gmt":"2013-09-12T13:57:19","slug":"sanral-succeeds-with-n2-appeal","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/45858\/sanral-succeeds-with-n2-appeal\/","title":{"rendered":"Sanral succeeds with N2 appeal"},"content":{"rendered":"<p>The SA National Roads Agency (Sanral&#8217;s) appeal regarding operation and maintenance of the N2 South Coast toll plaza was upheld in the Supreme Court of Appeal (SCA) on Thursday (12 September).<\/p>\n<p>Sanral appealed against a high court judgment reviewing and setting aside a tender awarded for the operation and maintenance of the plaza.<\/p>\n<p>The agency had invited tenders for the operation of the plaza and four tenders had been received.<\/p>\n<p>The contract was awarded to Tolcon Lehumo.<\/p>\n<p>A consortium of three companies operating under the name of The Toll Collect Consortium was dissatisfied and brought review proceedings in the High Court in Durban.<\/p>\n<p>The review succeeded but Sanral appealed to the SCA.<\/p>\n<p>On Thursday, the SCA held that judicial review was not a means of obtaining a fresh evaluation of the assessment of competing tenders and the decision to award a tender.<\/p>\n<p>Judge Malcolm Wallis ruled, in a unanimous full-bench decision, a judicial review was a mechanism to ensure that obligations imposed on public bodies by the Constitution and legislation were observed when tenders were awarded.<\/p>\n<p>&#8220;The court could only interfere if the process was infected with illegality,&#8221;
