{"id":475090,"date":"2021-03-11T11:49:00","date_gmt":"2021-03-11T09:49:00","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=475090"},"modified":"2021-03-11T11:49:42","modified_gmt":"2021-03-11T09:49:42","slug":"south-africas-state-of-disaster-extended-by-another-month","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/government\/475090\/south-africas-state-of-disaster-extended-by-another-month\/","title":{"rendered":"South Africa&#8217;s state of disaster extended by another month"},"content":{"rendered":"<p>President Cyril Ramaphosa\u2019s cabinet has approved the extension of South Africa\u2019s national state of disaster by a further month.<\/p>\n<p>In a briefing to media on Thursday (11 March), cabinet said that the National State of Disaster is now set to continue until 15 April 2021.<\/p>\n<p>Government declared a national state of disaster under Section 27(1) and Section 27(2) of the Disaster Management Act on 15 March 2020 in response to the coronavirus pandemic.<\/p>\n<p>While the state of disaster was originally set to lapse on 15 June &#8211; three months after it came into effect &#8211; the act provides that it may be extended by the Cooperative Governance and Traditional Affairs (Cogta) minister for a month at a time before it lapses.<\/p>\n<p>An official directive confirming the extension has not yet been gazetted by Cooperative Governance and Traditional Affairs minister Nkosazana Dlamini-Zuma.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\"><a href=\"https:\/\/twitter.com\/hashtag\/PostCabinet?src=hash&amp;ref_src=twsrc%5Etfw\">#PostCabinet<\/a>: Cabinet approved the extension of National State of Disaster to 15 April 2021. This is done in terms of Section 27(5) (C) of the Disaster Management Act, 2002 (Act 57 of 2002).<\/p>\n<p>\u2014 GCIS Media Liaison (@GCISMedia) <a href=\"https:\/\/twitter.com\/GCISMedia\/status\/1369945518965731328?ref_src=twsrc%5Etfw\">March 11, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><strong>Criticism<\/strong><\/p>\n<p>The latest extension marks a full year since the first state of disaster was introduced, with opponents criticising government for its ability to perpetually extend a state of disaster without any oversight.<\/p>\n<p>In February, the opposition Democratic Alliance announced plans to introduce the Draft Disaster Management Bill, which aims to change South Africa\u2019s laws around how a state of disaster is handled.<\/p>\n<p>\u201cIt may be argued that the scope of the minister\u2019s powers under a national state of disaster are necessary to enable the national executive to deal effectively with phenomena such as the Covid-19 pandemic, but save for the requirement of publication, the act does not provide for any formal procedural constraints on how these powers are to be exercised,\u201d the DA said.<\/p>\n<p>\u201cThe risks so created for the abuse of state power resemble the risks that have historically been associated with a state of emergency.\u201d<\/p>\n<p>It added that unlike the State of Emergency Act which was introduced in 1997, the current Disaster Management Act does not allow parliament to review the extension of a national state of disaster.<\/p>\n<p>The DA\u2019s proposed Disaster Management Amendment Bill aims to change this by establishing similar parliamentary supervision over national states of disaster.<\/p>\n<p>In this way, it will also act as a \u2018bulwark\u2019 against executive encroachment on the legislative authority of parliament, it said.<\/p>\n<p>\u201cThe draft bill therefore seeks to subject the wide-ranging powers of the Minister to declare and extend a national state of disaster, and to make subordinate legislation pursuant to such a declaration, subject to parliamentary supervision.<\/p>\n<p>\u201cThe draft bill also seeks to limit the initial period a national state of disaster can be declared to the same 21-day limit that our law currently places on a state of emergency, the latter resembling the former in key respects.\u201d<\/p>\n<hr \/>\n<p><strong>Read: <a href=\"https:\/\/businesstech.co.za\/news\/energy\/475016\/changing-energy-regulations-will-help-stop-load-shedding-in-south-africa-da\/\" target=\"_blank\" rel=\"noopener\">Changing energy regulations will help stop load shedding in South Africa: DA<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Cyril Ramaphosa\u2019s cabinet has approved the extension of South Africa\u2019s national state of disaster by a further month.<\/p>\n","protected":false},"author":10,"featured_media":461336,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[23],"tags":[26],"class_list":["post-475090","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-government","tag-headline"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/475090","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=475090"}],"version-history":[{"count":3,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/475090\/revisions"}],"predecessor-version":[{"id":475098,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/475090\/revisions\/475098"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/461336"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=475090"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=475090"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=475090"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
