{"id":48132,"date":"2013-10-23T13:30:02","date_gmt":"2013-10-23T11:30:02","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=48132"},"modified":"2013-10-23T13:31:24","modified_gmt":"2013-10-23T11:31:24","slug":"uncapped-adsl-has-its-limits-asa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/internet\/48132\/uncapped-adsl-has-its-limits-asa\/","title":{"rendered":"Uncapped ADSL has its limits: ASA"},"content":{"rendered":"<p>The Advertising Standards Authority of South Africa (ASA) has dismissed complaints from two Mweb subscribers, centering around the enforcement of its uncapped ADSL acceptable use policy (AUP).<\/p>\n<p>According to the ASA, the essence of the complaint was that the two subscribers had received warning letters for \u201c\u2026 repeated instances of continuous bulk downloads over prolonged periods\u201d, while failure to address this will result in Mweb taking \u201c\u2026 steps to cancel your service\u201d.<\/p>\n<p>The complainants said that the product (in this case 1Mbps uncapped for R199\/month) should not be described as \u201cUncapped\u201d when Mweb is actually monitoring use and terminating connections based on the volumes of data consumed.<br \/>\nMweb uncapped ADSL warning letters<\/p>\n<p>These most recent complaints come after a fierce online backlash in August 2013 when Mweb first started sending such warning letters to some of its customers.<\/p>\n<p>Responding to criticism online, a spokesperson for Mweb said that only 3% of its users have received warning letters.<\/p>\n<p>The ISP also explained that its manual methods of enforcing its AUP had proven ineffective in managing excessive usage patterns, so it had to automate it by imposing speed limits on users based on a 30-day rolling window metric.<\/p>\n<p>When asked about the change, the head of Mweb Internet service provider (ISP), Derek Hershaw said that the ISP was clamping down on the minority of users consuming a disproportionately high amount of bandwidth.<\/p>\n<p>\u201cAs is the case with all networks, you have a mix of users, and at the very top-end you have a small group who consume a significant and disproportionate amount of your capacity,\u201d Hershaw told MyBroadband at the time.<\/p>\n<p>\u201cWhen that starts to have a negative impact on the experience of the rest of your customers, you have to intervene,\u201d he said.<\/p>\n<p>\u201cWe\u2019ve always managed abusive behaviour in the past and, even though we\u2019re enforcing our fair-use policy a little bit more strictly now, it\u2019s still a very small portion of customers who are affected,\u201d Hershaw said.<\/p>\n<div id=\"attachment_30481\" style=\"width: 610px\" class=\"wp-caption alignleft\"><a  data-lightbox=\"post-image\" href=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/01\/derek-hershaw.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-30481\" class=\"size-full wp-image-30481\" alt=\"Derek Hershaw - MWEB\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/01\/derek-hershaw.jpg\" width=\"600\" height=\"400\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/01\/derek-hershaw.jpg 600w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/01\/derek-hershaw-300x200.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-30481\" class=\"wp-caption-text\">Derek Hershaw<\/p><\/div>\n<h3 class=\"my-4\">ASA sides with Mweb<\/h3>\n<p>In its ruling on the matter, the ASA laid out the following definitions it uses for broadband products:<\/p>\n<p>Capped refers to packages that allow you a predetermined amount of data, but terminate connection once you reached this predetermined limit.<\/p>\n<p>Uncapped refers to packages where your connection is never terminated, irrespective of how much data you use. However, it is accepted that instances of throttling or shaping may well occur at some threshold levels to ensure sustainability of the service for all customers.<\/p>\n<p>Unlimited refers to instances where there are literally no limits, i.e. no throttling or shaping and no restrictions on use.<\/p>\n<p>In this particular instance, the ASA said its Directorate \u201cis faced with a conundrum, in that the amount of data used by the two complainants appears to be excessive.\u201d<\/p>\n<p>According to the ASA, the one complainant had used enough data to fill roughly 174 DVDs (around 817GB), while the other could fill just under 64 DVDs (300GB) with the amount of data they had downloaded.<\/p>\n<p>\u201cThe respondent [Mweb] pointed out that when the complainants signed up for this contract, they had to actively accept the AUP and agree to abide by it,\u201d the ASA said. \u201cThis means that, when the complainants did so, they effectively agreed not to abuse the system in a manner that would prejudice other customers.\u201d<\/p>\n<p>Citing information that Mweb had sent the complainants multiple warning letters, and accepting that they are hypothetically reasonable people, \u201cpersisting with impermissible actions despite being warned to stop is not indicative of reasonable behaviour,\u201d the ASA said.<\/p>\n<p>According to the ASA, a hypothetical reasonable person would presumably alter their behaviour when receiving warning letters from a service provider that they are abusing the system.<\/p>\n<p>\u201cThis, in turn, would suggest that the complainant\u2019s expectation of an unrestricted free-for-all service \u2013 even if it compromises the quality of other customers \u2013 is neither reasonable nor justifiable,\u201d the ASA said.<\/p>\n<p>It added that there was nothing before it to suggest that customers who abide by the Mweb\u2019s AUP would see their connection terminated for any reason, which the ASA said means that
