JSE-listed IT company,\u00a0Gijima<\/a>\u00a0says it is confident that it will overcome its legal dispute with IT subcontracting\u00a0firm, Anderson Scanning Technologies (AST).<\/p>\n

Last month, Gijima was ordered to appear in court, facing a R184 million\u00a0damage claim by\u00a0AST who was axed by Gijima from a contract to\u00a0digitise the records in\u00a0South Africa\u2019s deeds offices.<\/p>\n

Gijima said it commenced a due diligence to establish Anderson Scanning\u2019s solvency. The group thereafter\u00a0applied for the liquidation of AST after it became apparent “that they were\u00a0hopelessly\u00a0insolvent,” said Gijima\u00a0CEO,\u00a0Eileen Wilton<\/a>.<\/p>\n

According to an article in The Sunday Independent, in papers filed at the Johannesburg High Court, AST MD Andrew Anderson accused Gijima of bringing an application for AST\u2019s winding up with \u201cproverbial dirty hands\u201d.<\/p>\n

\u201cAST had a number of defences against the liquidation application, the pivotal one of which is that Gijima launched its liquidation application with proverbial dirty hands, it (Gijima) having been entirely responsible for the financial discomfort AST was experiencing,\u201d Anderson said in court papers.<\/p>\n

\u201cGijima\u2019s arrogance is astounding: it has no right, contractually or otherwise to be in possession of AST\u2019s information and assets yet it brazenly appoints itself as the guardian thereof,” the MD said.<\/p>\n

In a telephone interview with BusinessTech, Wilton\u00a0said that the work to\u00a0scan all records in the deeds offices “is highly complex”. She said that, having appointed AST, it soon became clear that “this job was beyond its\u00a0capabilities…the subcontractor could not perform”.<\/p>\n

With the\u00a0company\u00a0seemingly out of its depth, Wilton said that\u00a0Anderson Scanning “agreed that they wanted out”. The CEO said that, having\u00a0conducted\u00a0further due diligence on the\u00a0firm, it became apparent that it was “hopelessly insolvent”.<\/p>\n

Wilton said that she worked with ACT personally. “I absolutely am sure that I gave them ample time to perform. They\u00a0couldn’t\u00a0deliver and got into huge debt.”<\/p>\n

Gijima said it assisted AST with R80 million in funding for working capital requirements<\/p>\n

Wilton said that Gijima has since put in its own team to work on the contract with the deeds office. “We have been able to deliver,” the CEO said. “This was simply something beyond them”.<\/p>\n

“I cant prejudge the court, but we are confident in our case,” Wilton said.<\/p>\n

Gijima said that no clear date for a court\u00a0appearance\u00a0has been set.<\/p>\n
