{"id":49153,"date":"2013-11-08T12:01:20","date_gmt":"2013-11-08T10:01:20","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=49153"},"modified":"2013-11-08T12:02:55","modified_gmt":"2013-11-08T10:02:55","slug":"outa-calls-for-swift-ruling-on-e-tolls","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/49153\/outa-calls-for-swift-ruling-on-e-tolls\/","title":{"rendered":"Outa calls for swift ruling on e-tolls"},"content":{"rendered":"<p>The Opposition to Urban Tolling Alliance (Outa) has welcomed the <a title=\"Democratic Alliance\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1696-DA-Democratic-Alliance\">Democratic\u00a0Alliance<\/a>\u00a0and FF+ announcements to file legal papers of additional challengesto the constitutionality and lawfulness of the e-toll regulations and other related matters.<\/p>\n<p>The group says it hopes that the Judiciary will be prompt in its judgment so as to be expedited before Parliament adjourns for the National and Provincial Elections.<\/p>\n<p>Zuma signed the Transport Laws and Related Matters Amendment Bill into law towards the end of September, enabling the\u00a0e-tolling of Gauteng\u2019s freeways through the Gauteng Freeway Improvement Project (GFIP).<\/p>\n<p>Last month (October), the Supreme Court of Appeal dismissed an appeal by the Opposition to Urban Tolling Alliance (<a title=\"Outa\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1949-OUTA-Opposition-to-Urban-Tolling-Alliance\">Outa<\/a>) in its e-toll challenge against the SA National Roads Agency Ltd (<a title=\"Sanral\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/1722-SANRAL-South-African-National-Roads-Association-Limited\">Sanral<\/a>).<\/p>\n<p>Government aims to implement e-tolling for Gauteng roads before December.<\/p>\n<p>On Thursday (7 November), however,\u00a0The DA\u00a0submitted papers to the High Court for a new challenge that, if successful, could delay the roll out of e-tolls on\u00a0Gauteng\u2019s freeways.<\/p>\n<p>Outa said that the DA&#8217;s decision to challenge e-tolls will afford the Legislature another chance to scrutinize the rationality and desirability of e-tolling.<\/p>\n<p>The DA is arguing that the Gauteng and other Provincial Legislatures have been wrongfully bypassed in having a say in the enactment of the Transport Laws and Related Matters Amendment Bill by the National Assembly.<\/p>\n<p>\u201cOuta\u2019s court challenge has served to raise issues that were never openly debated at the outset, because of Sanral\u2019s failure to meaningfully consult the public\u201d said Wayne Duvenage, chairman of Outa.<\/p>\n<p>\u201cWe therefore maintain the legislation lacks both ethical legitimacy, as well as formal lawfulness. Religious leaders, led by the Catholic Bishops, have already said as much with respect to the morality of e-tolling, while the Supreme Court of Appeal remained silent about the latter, in the Outa\u00a0application.&#8221;<\/p>\n<p>&#8220;We have no doubt that if reviewed on the basis of rationality, workability, efficiency and citizens rights, e-tolling should be abandoned.\u201d<\/p>\n<p>\u201cWe are confident that in a free vote, the e-tolling bill will be overwhelmingly defeated.
