{"id":499529,"date":"2021-06-18T15:07:13","date_gmt":"2021-06-18T13:07:13","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=499529"},"modified":"2021-06-18T15:07:13","modified_gmt":"2021-06-18T13:07:13","slug":"it-might-be-time-to-review-some-of-south-africas-business-laws-mboweni","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/499529\/it-might-be-time-to-review-some-of-south-africas-business-laws-mboweni\/","title":{"rendered":"It might be time to review some of South Africa&#8217;s business laws: Mboweni"},"content":{"rendered":"<p>Tito Mboweni, the architect of many of South Africa\u2019s labour laws, said it may be time to review them to ensure they aren\u2019t impeding economic growth.<\/p>\n<p>South Africa\u2019s current finance minister told an investment conference on Thursday that when he served as the first post-apartheid labour minister from 1994 to 1998 \u201cwe made a number of mistakes that need to be attended to.\u201d<\/p>\n<p>\u201cTo what extent are some of the labour policies we put in place acting as binding constraints?\u201d he said at the conference organized by JSE and sponsored by Citibank and Absa Group.<\/p>\n<p>\u201cHow do we make sure that our labour laws don\u2019t impinge on the ability of small and medium enterprises to function effectively?\u201d<\/p>\n<p>South Africa\u2019s labour laws have been praised and criticized in turn for protecting workers rights and discouraging hiring in a country where a third of the labour force is unemployed &#8211; in part because of their rigidity.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">In case you missed out:<\/p>\n<p>Minister of Finance <a href=\"https:\/\/twitter.com\/tito_mboweni?ref_src=twsrc%5Etfw\">@tito_mboweni<\/a> participating at the Annual SA Tomorrow Investor Conference. Find the full video here: <a href=\"https:\/\/t.co\/Zt5qDxEtSz\">https:\/\/t.co\/Zt5qDxEtSz<\/a><\/p>\n<p>\u2014 National Treasury (@TreasuryRSA) <a href=\"https:\/\/twitter.com\/TreasuryRSA\/status\/1405552255684825098?ref_src=twsrc%5Etfw\">June 17, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><strong>Union opposition<\/strong><\/p>\n<p>While labour unions would oppose any changes, a commission should perhaps be set up to examine the laws and amend them where necessary, said Mboweni, who also served as central bank governor for a decade.<\/p>\n<p>The minister was adamant the Treasury won\u2019t back down on its insistence that any wage agreement for state workers mustn\u2019t breach the government\u2019s fiscal ceiling &#8211; a stance that\u2019s stoking tension with powerful labour unions allied to the ruling African National Congress.<\/p>\n<p>Last year, the government reneged on a prior deal to raise wages for 1.3 million government workers, and in February Mboweni announced a new three-year pay freeze in the public sector as part of plans to rein in spending, reduce the budget deficit and stabilize debt.<\/p>\n<p>Unions, which are demanding increases of inflation, which averaged 3.3% last year, plus four percentage points, have threatened to strike. Mboweni stressed that workers\u2019 rights would need to be protected.<\/p>\n<p>\u201cWhatever we do, we have to operate within that fiscal framework,\u201d he told the conference. \u201cWhatever arrangements they come to, those arrangements cannot be changed. The fiscal framework is sacrosanct.\u201d<\/p>\n<p>Mboweni also said he would prefer employment incentives to a basic income grant.
