{"id":51615,"date":"2014-01-13T17:06:06","date_gmt":"2014-01-13T15:06:06","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=51615"},"modified":"2014-01-13T17:09:43","modified_gmt":"2014-01-13T15:09:43","slug":"da-e-toll-court-case-looms","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/51615\/da-e-toll-court-case-looms\/","title":{"rendered":"DA e-toll court case looms"},"content":{"rendered":"<p>The Democratic Alliance says that its legal case against the\u00a0implementation\u00a0of e-tolls on Gauteng&#8217;s freeways has been\u00a0set down for 4-5 March 2014.<\/p>\n<p>The DA submitted papers to the High Court in November 2013, arguing that\u00a0the legislation governing e-tolling was\u00a0incorrectly tagged and should be declared unconstitutional.<\/p>\n<p>In a\u00a0statement\u00a0on Monday (13\u00a0January), the DA said that its &#8216;fight&#8217; against e-tolls, implemented on 3 December, has been set down to take place in the\u00a0ConCourt on 4 and 5 March 2014.<\/p>\n<p>&#8220;In 2014, we can choose the path of change and jobs, or we can choose 5 more years of the same from Zuma\u2019s ANC,&#8221;\u00a0said\u00a0Mmusi Maimane, DA\u00a0Gauteng Premier Candidate.<\/p>\n<p>&#8220;As Premier I will make jobs my top priority, stop corruption in government and fight against the unjust taxation of Gauteng residents through e-tolling,&#8221; he said.<\/p>\n<p>The DA has contended that the Constitution made a distinction between Bills that had an impact on national government and those which affected provincial government.<\/p>\n<p>Maimane said the e-toll Bill was incorrectly tagged as a national competency that should be dealt with by the national government.<\/p>\n<p>The Gauteng legislature should have been given an opportunity to vote for or against the Bill, the DA said.<\/p>\n<p>&#8220;We believe that the incorrect tagging of the e-toll Bill effectively prevented the provincial legislature from deliberating on the e-toll Bill on behalf of the affected people,&#8221; Maimane said.<\/p>\n<p>\u201cHowever, the tolling of roads impacts on many factors such as urban planning, public transport and traffic regulations \u2013 all of which are the competency of provincial governments and municipalities,\u201d the political candidate said.<\/p>\n<p>\u201cBecause of this collective responsibility, the Bill should have been dealt with by the National Assembly, the NCOP and all provincial legislatures (called a section 76 Bill),\u201d\u00a0Maimane said.<\/p>\n<div id=\"attachment_49094\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a  data-lightbox=\"post-image\" href=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/11\/Mmusi-Maimane.png\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-49094\" class=\"size-full wp-image-49094\" alt=\"Mmusi Maimane\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/11\/Mmusi-Maimane.png\" width=\"600\" height=\"400\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/11\/Mmusi-Maimane.png 600w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/11\/Mmusi-Maimane-300x200.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-49094\" class=\"wp-caption-text\">Mmusi Maimane<\/p><\/div>\n<p>The DA said that, if the Bill is declared unconstitutional it would mean that the National Assembly will have to start their deliberations again, and hold another vote on the Bill.
