{"id":519666,"date":"2021-09-10T17:00:40","date_gmt":"2021-09-10T15:00:40","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=519666"},"modified":"2021-09-10T15:27:46","modified_gmt":"2021-09-10T13:27:46","slug":"sars-makes-good-on-its-promise-to-come-down-hard-on-non-compliant-taxpayers","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/finance\/519666\/sars-makes-good-on-its-promise-to-come-down-hard-on-non-compliant-taxpayers\/","title":{"rendered":"SARS makes good on its promise to come down hard on non-compliant taxpayers"},"content":{"rendered":"<p>The South African Revenue Service is making good on its promise to chase after taxpayers who are non-compliant, having been discussed for months by commissioner Edward Kieswetter and re-emphasized in a media statement in August, says Jashwin Baijoo, legal manager at Tax Consulting SA.<\/p>\n<p>Baijoo cited a recent case where a taxpayer was served with a summons to appear in the magistrate\u2019s court, charged on not one but <strong>29 counts of non-compliance.<\/strong><\/p>\n<p>&#8220;Without limiting any prospects of recovery, the revenue authority evidently did its homework, and duly investigated the behaviour of the taxpayer, with counts 1 \u2013 11, on the non-submission of the taxpayer\u2019s PAYE returns, which is an integral part of the operations in any business,&#8221; he said.<\/p>\n<p>&#8220;The same can be said for counts 12 \u2013 24, which focused entirely on the non-submission of the taxpayer\u2019s VAT returns and counts 25 \u2013 29 canvassing the taxpayer\u2019s non-compliance from a Corporate Income Tax perspective.&#8221;<\/p>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-1-11.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-519678 aligncenter\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-1-11.png\" alt=\"\" width=\"665\" height=\"156\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-1-11.png 665w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-1-11-300x70.png 300w\" sizes=\"auto, (max-width: 665px) 100vw, 665px\" \/><\/a><\/p>\n<p><a  data-lightbox=\"post-image\" href=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-12.png\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-519676 aligncenter\" src=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-12.png\" alt=\"\" width=\"670\" height=\"170\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-12.png 670w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2021\/09\/Counts-12-300x76.png 300w\" sizes=\"auto, (max-width: 670px) 100vw, 670px\" \/><\/a><\/p>\n<p>Baijoo noted that SARS has made good on its word of increasingly focusing on non-compliance, including tax mistakes, which enable the prosecution of taxpayers for offences committed <strong>&#8216;willfully and without just cause&#8217;<\/strong>.<\/p>\n<p>&#8220;Matters of non-compliance are not to be taken lightly by taxpayers, and even the smallest mistake can land you in serious hot water, with the Hawks knocking at your door, to personally deliver your invite to a rendezvous with the revenue authority,&#8221; he said.<\/p>\n<p><strong>The solution to non-compliance<\/strong><\/p>\n<p>Other cases show SARS upping its collection power to offset a massive budget deficit with aggressive collection steps, including salary garnishes, sheriff callouts, and even taking money directly from business and\/or personal accounts, said Baijoo.<\/p>\n<p>&#8220;Now is not the time to take risks.
