{"id":52545,"date":"2014-01-31T09:40:03","date_gmt":"2014-01-31T07:40:03","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=52545"},"modified":"2014-01-31T12:21:14","modified_gmt":"2014-01-31T10:21:14","slug":"sa-digital-tax-coming-in-april","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/52545\/sa-digital-tax-coming-in-april\/","title":{"rendered":"SA digital tax coming in April"},"content":{"rendered":"<p><a title=\"Treasury\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/5666-National-Treasury\">Treasury<\/a> has published new electronic services regulations, detailing which digital products and services will be subject to 14% VAT come 1 April 2014.<\/p>\n<p>The regulations have been published by Finance Minister <a title=\"Pravin Gordhan\" href=\"http:\/\/businesstech.co.za\/forum\/showthread.php\/5145-Pravin-Gordhan\">Pravin Gordhan<\/a> for comment, and follow the proposals he made in his 2013 budget speech to impose VAT on foreign businesses who \u201csell e-books, music and other digital goods and services\u201d.<\/p>\n<p>The regulations are called the Electronic Services Regulations and come into operation on a proposed date of 1 April 2014.<\/p>\n<p>&#8220;This announcement was made against the backdrop of efforts, both internationally and locally, to bring cross border e-commerce (specifically the digital economy) into the VAT regime,&#8221; Treasury said in a statement.<\/p>\n<p>&#8220;The current application of VAT on imports does not lend itself to the effective enforcement on imported services or e-commerce where no border posts (or parcel delivery agents, e.g. the Post Office) can perform the function as collecting agents, as is the case with physical goods.&#8221;<\/p>\n<p>&#8220;The net result is that the local consumers can buy imported digital products without paying VAT. This outcome not only places local suppliers of digital services at a competitive disadvantage (compared to suppliers from abroad) but also results in a loss of revenue for the fiscus.&#8221;<\/p>\n<div id=\"attachment_32478\" style=\"width: 610px\" class=\"wp-caption alignleft\"><a  data-lightbox=\"post-image\" href=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/02\/Pravin-Gordhan.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-32478\" class=\"size-full wp-image-32478\" alt=\"Pravin Gordhan\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/02\/Pravin-Gordhan.jpg\" width=\"600\" height=\"400\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/02\/Pravin-Gordhan.jpg 600w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2013\/02\/Pravin-Gordhan-300x200.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-32478\" class=\"wp-caption-text\">Pravin Gordhan<\/p><\/div>\n<p>In terms of the regulations, the VAT will apply to any supplier of electronic services from an \u201cexport country\u201d to any resident in South Africa, or where payment is made from a local bank.<\/p>\n<p>What exactly will be taxed? The list below details all digital goods and services which will be impacted, according to the regulation document:<\/p>\n<h3 class=\"my-4\">Educational services<\/h3>\n<ul>\n<li>distance teaching programmes;<\/li>\n<li>educational webcasts;<\/li>\n<li>internet-based courses;<\/li>\n<li>internet-based education programmes; or<\/li>\n<li>webinars,<\/li>\n<\/ul>\n<h3 class=\"my-4\">Games and games of chance<\/h3>\n<ul>\n<li>internet-based games, including any electronic game or multiplayer role-playing game;<\/li>\n<li>interactive games, such as games of chance, where the result is influenced by the skill of the player;<\/li>\n<li>electronic betting or wagering.<\/li>\n<\/ul>\n<h3 class=\"my-4\">Information system services<\/h3>\n<h3 class=\"my-4\">Internet-based auction service<\/h3>\n<h3 class=\"my-4\">Maintenance services<\/h3>\n<p>Which refers to technical support relating to<\/p>\n<ul>\n<li>blogs;<\/li>\n<li>databases;<\/li>\n<li>information systems;<\/li>\n<li>information system services; and<\/li>\n<li>websites.<\/li>\n<\/ul>\n<h3 class=\"my-4\">Online content<\/h3>\n<ul>\n<li><strong>e-books<\/strong>, which means any digitised content of any book or electronic publication;<\/li>\n<li><strong>films<\/strong>, which means any broadcast, documentary home-made video, live streaming performance, movie, music video, program, television series, or video<\/li>\n<li><strong>images<\/strong>, which means any desktop theme, photographic image, pictorial image, or screensaver,<\/li>\n<li><strong>music<\/strong>, which means any audio clip, broadcast jingle, live streaming performance, ringtone, song, or sound effect,<\/li>\n<li><strong>software<\/strong>, including apps, system software, or plugins, and any update to these programs.<\/li>\n<\/ul>\n<h3 class=\"my-4\">Subscription services<\/h3>\n<p>Any subscription service to:<\/p>\n<ul>\n<li>blogs;<\/li>\n<li>databases;<\/li>\n<li>information system services;<\/li>\n<li>journals;<\/li>\n<li>magazines;<\/li>\n<li>newspapers;<\/li>\n<li>games;<\/li>\n<li>social networking services;<\/li>\n<li>webcasts;<\/li>\n<li>websites;<\/li>\n<li>web applications; or<\/li>\n<li>web series.<\/li>\n<\/ul>\n<p>The added taxes on digital goods is likely to push the price of goods up, a tax expert has said.<\/p>\n<p>Following the initial proposal for a digital tax, Gerard Soverall, PWC \u2018s head of indirect tax, said that, considering the revenue generated by large online retailers, governments are losing out on large amounts of VAT.<\/p>\n<p>\u201cIt is a profit issue at the end of the day. VAT at 14% in South Africa is a material number in your profits so online businesses will pass that on [to consumers].
