{"id":54787,"date":"2014-03-25T09:40:29","date_gmt":"2014-03-25T07:40:29","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=54787"},"modified":"2014-03-25T09:40:29","modified_gmt":"2014-03-25T07:40:29","slug":"likely-outcomes-in-mobile-court-battle","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/mobile\/54787\/likely-outcomes-in-mobile-court-battle\/","title":{"rendered":"Likely outcomes in mobile court battle"},"content":{"rendered":"<p>The call termination rate legal battle is set to begin at the Johannesburg High Court on Tuesday morning (25 March 2014), with <a title=\"Vodacom\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/227063-Vodacom\">Vodacom<\/a> and <a title=\"MTN\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/226943-MTN\">MTN<\/a> in the one corner, and <a title=\"Icasa\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/462443-Independent-Communications-Authority-of-South-Africa-%28ICASA%29\">Icasa<\/a>, <a title=\"Cell C\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/213919-Cell-C\">Cell C<\/a> and <a title=\"Telkom\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/227037-Telkom\">Telkom<\/a> in the opposite corner.<\/p>\n<p>Icasa released its \u201cCall Termination Regulations, 2014\u201d on 29 January 2014, which will see mobile termination rates (MTR) reduced from the current 40 cents per minute to 10 cents per minute over the next three years.<\/p>\n<p>The regulations further call for significant asymmetry, up from the current 10% to 120% from March 2014, 180% from March 2015, and 300% from March 2016.<\/p>\n<p>Vodacom and MTN have challenged the regulations, arguing that a fair and objective process was not used to determine the final termination rates.<\/p>\n<p>The legal challenge from Vodacom and MTN is two-fold:<\/p>\n<ul>\n<li>An urgent application to stop the implementation of the 2014 Call Termination Regulations on 1 April 2014;<\/li>\n<li>An application to set aside the 2014 Call Termination Regulations (hence, ask Icasa to go back to the drawing board and follow the correct process).<\/li>\n<\/ul>\n<p>Last week, Bloomberg reported that The Independent Communications Authority of South Africa (Icasa) will review its original decision to cut mobile termination rates following legal pressure from Vodacom and MTN Group.<\/p>\n<p>According to a document seen by Bloomberg, Icasa \u201chas decided to engage in a reconsideration of the termination rates applicable for the years beginning 1 April 2015 and 1 April 2016\u2033.<\/p>\n<p>The media company said that the watchdog confirmed the affidavit and its content, and said that the review is being conducted with the aid of an external economist.<\/p>\n<h3 class=\"my-4\">Court battle<\/h3>\n<p>This week\u2019s court battle surrounding the 2014 Call Termination Regulations will focus on whether the regulations should be implemented immediately or not (hence, whether the urgent application is granted or not).<\/p>\n<p>Vodacom and MTN will argue for the implementation to be stopped until a review process is completed.
