{"id":55610,"date":"2014-04-11T15:14:10","date_gmt":"2014-04-11T13:14:10","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=55610"},"modified":"2014-04-11T15:50:50","modified_gmt":"2014-04-11T13:50:50","slug":"cell-c-nailed-over-accidental-anti-mtn-advert","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/mobile\/55610\/cell-c-nailed-over-accidental-anti-mtn-advert\/","title":{"rendered":"Cell C nailed over &#8216;accidental&#8217; anti-MTN advert"},"content":{"rendered":"<p>Cell C has landed itself in hot water with the Advertising Standards Authority of South Africa (ASA) over an advert quoting consumers calling MTN corrupt, mad and greedy &#8211; which was &#8220;mistakenly&#8221; uploaded to Cell C&#8217;s YouTube channel.<\/p>\n<p>The commercial &#8211; which according to Cell C was pulled as soon as it had received complaints from MTN &#8211; was apparently part of a <strong><a title=\"http:\/\/businesstech.co.za\/news\/mobile\/54497\/cell-c-bites-back-at-mtn-open-letter\/\" href=\"http:\/\/businesstech.co.za\/news\/mobile\/54497\/cell-c-bites-back-at-mtn-open-letter\/\">campaign against MTN<\/a><\/strong> over the latter&#8217;s court challenges against Icasa&#8217;s call termination regulations 2014.<\/p>\n<p>The commercial asked the question: \u201cWhat\u2019s upsetting South Africans?\u201d<\/p>\n<p>\u201cThe National Regulator has ordered cellular networks to reduce interconnect rates. These are the fees that networks charge each other when you make calls from one network to another.&#8221;<\/p>\n<p>&#8220;Now, if interconnect rates are reduced this will mean more competition in the industry and ultimately could result in lower prices for you. However, not everyone is happy about this.&#8221;<\/p>\n<p>&#8220;In fact, one of South Africa\u2019s biggest and most profitable cellular companies is taking the Regulator to court to fight this. Here\u2019s what South Africa had to say.\u201d<\/p>\n<p>The commercial then showed different people making the following statements about the unnamed company:<\/p>\n<ul>\n<li>\u201cIt comes down to corporate greed\u201d;<\/li>\n<li>\u201cIt\u2019s not\u2026 now it\u2019s corruption. It\u2019s something else now, it\u2019s not a business anymore\u201d;<\/li>\n<li>\u201cIt is not fair, because not all of us [can] afford these costs\u201d;<\/li>\n<li>\u201cThat\u2019s the biggest, biggest madness, what they are doing. That\u2019s rubbish\u201d;<\/li>\n<li>\u201cSo all they\u2019re thinking of is profit, profit, profit\u201d;<\/li>\n<li>\u201cThey\u2019re selfish, because if you have that kind of money and you still want more, that means you\u2019re not thinking about your clients; you\u2019re thinking about yourself\u201d;<\/li>\n<li>\u201cThey should stop stealing our money. They should stop what they are doing\u201d;<\/li>\n<li>\u201cBut I think I should change now. Seriously, if they\u2019re going that route they\u2019re going to lose customers\u201d<\/li>\n<li>\u201cI\u2019m gonna tell them you\u2019re shooting yourself in the foot, you\u2019re gonna lose all your customers. South Africans aren\u2019t stupid, we all know there\u2019s options, you know.\u201d<\/li>\n<\/ul>\n<p>The commercial then stated: \u201cSo ask yourself \u2013 is your network treating you fairly? Maybe you should change to the network who\u2019s on your side.\u201d<\/p>\n<p>MTN argued that consumers would understand the commercial to be referring to its network, and challenged the contents, saying the statements are misleading, dishonest and disparaging.<\/p>\n<h3 class=\"my-4\">Cell C: Sorry, our mistake<\/h3>\n<p>In response to the complaint, Cell C admitted that the commercial in question was rejected by Cell C\u2019s legal department but, despite this, somehow came to be uploaded to YouTube.<\/p>\n<p>Cell C undertook to not flight it in any form again, and apologised for \u201cthe internal mistakes that led to this unfortunate error.\u201d<\/p>\n<p>When pressed by the ASA for a proper response to the specifics of MTN&#8217;s complaint, Cell C didn&#8217;t deny that ad was referring to MTN, but maintained that it contained true, unscripted responses, and was in the public interest.<\/p>\n<p>In ruling on the matter, the ASA noted that, irrespective of the &#8220;unscripted&#8221; nature of the statements, the responses were emotive and subjective, and not relaying any facts in the public interest.<\/p>\n<p>&#8220;These emotive statements communicate to consumers that MTN is greedy and corrupt, and that they are stealing consumers\u2019 money.
