{"id":5683,"date":"2012-02-08T08:03:32","date_gmt":"2012-02-08T08:03:32","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=5683"},"modified":"2012-02-08T15:40:45","modified_gmt":"2012-02-08T15:40:45","slug":"us-court-jurisdiction-questioned-in-mtnturkcell-dispute","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/mobile\/5683\/us-court-jurisdiction-questioned-in-mtnturkcell-dispute\/","title":{"rendered":"US court jurisdiction questioned in MTN\/TurkCell dispute"},"content":{"rendered":"<p>TurkCell\u2019s intention to bring bribery claims against <a title=\"Company Information\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/226943-MTN\" target=\"_blank\">MTN<\/a> (MTN) before a US court is questionable, according to the legal advice given to the SA mobile operator.<\/p>\n<p>TurkCell confirmed that talks with South African mobile operator MTN are ongoing, with the former looking to bring a case against MTN and its subsidiary, Irancell, in a US court.<\/p>\n<p>MTN, which owns 49% of Irancell \u2013 the group that was awarded the Iranian GSM licence \u2013 said last Thursday (2 February 2012) that it had been informed by TurkCell that it believes it has a claim against MTN and its relevant subsidiary.<\/p>\n<p>This is arising out of the award of the second GSM Licence based on alleged violations of US laws, and TurkCell has indicated an intention to bring such a claim before a US court.<\/p>\n<p>According to MTN, TurkCell claimed that it had asked South Africa to support Iran\u2019s nuclear development in return for a license.<\/p>\n<p>Turkcell however, would not comment on any of the legal action MTN referred to last week.<\/p>\n<p>MTN hosted a management conference call for investors and analysts, and suggested that\u00a0jurisdiction of a US court over a potential claim is questionable.<\/p>\n<p>An analyst who took part in the conference call said that the potential claim is understood to be against MTN Group and not MTN\u00a0Irancell.<\/p>\n<p>MTN has appointed a special committee to assess the potential TurkCell claim, headed by Lord Hoffmann.
