The Justice Project South Africa (JPSA) says that the Sanral Violations Processing Centre (VPC) has started sending out emails stating that \u201cA Final Demand has been issued in regard to your e-toll Violations Processing Centre (VPC) Account\u201d and \u201cA summons has been issued\u201d.<\/p>\n
\u201cIt is not clear at this stage whether the summons referred to in the email is a civil or criminal summons, as neither the Final Demand nor the summons has as yet been received by the company in question,\u201d the JPSA said.<\/p>\n
\u201cWhat is clear, however, is that Sanral\u2019s VPC doesn\u2019t understand the concept of the term \u2018pre-legal\u2019, given the fact that they have referred to a summons already having been issued,\u201d the JPSA said.<\/p>\n
\u201cUsually \u2018pre-legal\u2019 communications precede the issue of a summons, which escalates the matter to the status of being a live legal issue.\u201d<\/p>\n
The JPSA added that for a summons to be issued, a court date would be required so that it may appear on the summons.<\/p>\n
\u201cIn light of the \u2018processes\u2019 described by spokespeople for Sanral, it is somewhat surprising that a Final Demand would have been issued and seconds later, a summons would have been issued,\u201d the JPSA said.<\/p>\n
\u201cThese actions deviate dramatically from the \u2018processes\u2019 that have been repeatedly described by Sanral representatives.\u201d<\/p>\n
