It also outlines the appropriate sentences that can be imposed on a person who commits such violations.<\/p>\n<p>During a <strong><a href=\"https:\/\/www.youtube.com\/watch?v=G5ssKkSRZXw\" target=\"_blank\" rel=\"noopener\">virtual committee meeting<\/a><\/strong> on Wednesday (7 September), John Jeffery, the deputy justice minister, said that parliament is actively engaging with the bill and has a working draft.<\/p>\n<p>Jeffery said that the idea behind the bill was to have a new crime of hate speech. It defines the following offences:<\/p>\n<ul>\n<li><strong>Hate crime<\/strong> &#8211; when a person commits any recognised offence motivated by prejudice or intolerance;<\/li>\n<li><strong>Hate speech<\/strong> &#8211; when a person publishes or shares statements that intend to be harmful or incite harm.<\/li>\n<\/ul>\n<p>&#8216;Hate Speech&#8217; under the bill includes the promotion or propagating of hatred based on the following categories:<\/p>\n<ul>\n<li>Age<\/li>\n<li>Albinism<\/li>\n<li>Birth<\/li>\n<li>Colour<\/li>\n<li>Culture<\/li>\n<li>Disability<\/li>\n<li>Ethnic or social origin<\/li>\n<li>Gender or gender identity<\/li>\n<li>HIV status<\/li>\n<li>Language<\/li>\n<li>Nationality or migrant or refugee status<\/li>\n<li>Race<\/li>\n<li>Religion<\/li>\n<li>Sex, which includes intersex<\/li>\n<li>Sexual orientation<\/li>\n<\/ul>\n<p>The bill also makes it an <strong>offence to distribute hate speech material in cyberspace<\/strong> &#8211; digitally or on digital channels, such as Whatsapp.<\/p>\n<p>Recently, social media law expert Emma Sadleir Berkowitz warned that a new update to Whatsapp could lead to legal trouble for group admins in South Africa.<\/p>\n<p>Under the <strong><a href=\"https:\/\/businesstech.co.za\/news\/technology\/622933\/new-whatsapp-change-could-lead-to-legal-trouble-for-group-admins-in-south-africa\/\" target=\"_blank\" rel=\"noopener\">new update,<\/a><\/strong> group admins will have the ability to delete any message sent to the group and &#8220;delete for all&#8221;, and the time limit for this function has been extended to a couple of days.<\/p>\n<p>In South African law, if you can delete something, and you choose not to, then you become legally responsible for the content, she said.<\/p>\n<p>\u201cIf you\u2019re the admin of a WhatsApp group, because of this recent change, you become legally responsible for everything that appears on that group.\u201d<\/p>\n<p>Any administrator of a group whose members are posting hate speech, threats, incitement, or other illegal content could face legal repercussions if that content is not removed, according to Sadlier Berkowitz.<\/p>\n<p><strong>How it expands the law<\/strong><\/p>\n<p>Jeffery said that existing law is not efficient enough in that, under the Promotion of Equality and prevention of Unfair Discrimination Act (PEPUDA), it involves civil matters where a person must approach the equality court within their capacity.<\/p>\n<p>Under the new bill, if it becomes law, a hate crime would be followed up by the state and criminally prosecuted.<\/p>\n<p>This is not the first piece of law that restricts people&#8217;s speech, said Jeffery.
