{"id":664399,"date":"2023-02-18T13:00:06","date_gmt":"2023-02-18T11:00:06","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=664399"},"modified":"2023-02-17T16:40:48","modified_gmt":"2023-02-17T14:40:48","slug":"what-the-law-says-about-severance-pay-in-south-africa-2","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/business\/664399\/what-the-law-says-about-severance-pay-in-south-africa-2\/","title":{"rendered":"What the law says about severance pay in South Africa"},"content":{"rendered":"<p>Employees are not entitled to severance pay when they are relieved of their duties if they unreasonably reject alternative employment.<\/p>\n<p>Recent data suggest that South Africa has a <a href=\"https:\/\/businesstech.co.za\/news\/finance\/664115\/recession-warning-for-south-africa\/\">68% chance<\/a> of entering a recession, which could lead to widescale retrenchments across the nation.<\/p>\n<p>Retrenchments could see many employees dismissed from their jobs; however, not all employees are legally entitled to severance pay.<\/p>\n<p>Jacques van Wyk, Michiel Heyns, and Danelle Plaatjies from <a href=\"https:\/\/www.werksmans.com\/legal-updates-and-opinions\/severance-pay-is-not-always-due-when-dismissed-for-operational-requirements\/\" target=\"_blank\" rel=\"noopener\">Werksmans Attorneys<\/a> highlighted the case of <em>Servest Landscaping Turf Maintenance v SACCAWY (2022)\u00a0<\/em>that dealt with a case where employees dismissed for operational requirements were not qualified for severance pay.<\/p>\n<p>According to Werkmans Attorneys, section 41(4) of the Basic Conditions of Employment Act (BCEA) states that an employer can refuse to pay their dismissed employees if they unreasonably refuse to &#8220;accept the employer&#8217;s offer of alternative employment with that employer or any other employer&#8221;.<\/p>\n<p>In a recent case, the labour court (LC) looked into the use of section 41(1).<\/p>\n<p>The court reaffirmed that the requirements of section 41(4) are satisfied if the dismissed employee is offered alternative employment with a new employer due to the retrenching employer&#8217;s actions, said Werkmans Attorneys.<\/p>\n<p>In a previous case &#8211; Irvin &amp; Johnson Ltd v Commission for Conciliation, Mediation &amp; Arbitration (CCMA) &amp; others (2006), the Labour Appeal Court (the LAC) stated that the legal purpose of severance pay is to help support the retrenchee while they search for a new job.<\/p>\n<p>However, a <strong>retrenchee who gets another job immediately would not be entitled<\/strong> to severance pay as they have found employment.<\/p>\n<p>The LAC also said that the BCEA rewards employers who find alternative employment for their retrenched employees.<\/p>\n<p>However, a dismissed employee who is offered alternative employment but the offer is not made via their retrenching employer is still entitled to severance pay &#8211; even if they refuse the alternative employment opportunity.<\/p>\n<p>In addition, an employee found to have reasonably refused alternative employment will still be entitled to severance pay.<\/p>\n<p><strong>Case<\/strong><\/p>\n<p>In the Servest case, the CCMA said that Servest failed to prove that it was responsible for finding 22 employees alternative employment at Bidvest.<\/p>\n<p>The CCMA found that Servest, at most, played a facilitating role and did not secure employment for the dismissed employees.<\/p>\n<p>Servest took the matter to the LC, which found that the arbitrator made an error of law, leading to a disregard of material evidence.<\/p>\n<p>The evidence suggested that Servest initiated the meetings with Bidvest and kept a close eye on Bidvest&#8217;s recruitment of its staff to ensure that no employee would be left unemployed or lose a day&#8217;s work.<\/p>\n<p>The LC said that the CCMA made an error of law in finding that only a binding undertaking by Servest from Bidvest could prove Servest secured alternative employment for its dismissed staff.<\/p>\n<p>The LC set aside the CCMA&#8217;s ruling and stated that the employees were not entitled to severance pay according to section 41(4) of the BCEA.<\/p>\n<p>Ultimately, a dismissed employee cannot expect a severance package if they found alternative employment through the efforts of their retrenching employer, but the retrenching employer must have evidence that they played an instrumental role in the process.<\/p>\n<hr \/>\n<p>Read: <a href=\"https:\/\/businesstech.co.za\/news\/business-opinion\/638681\/what-the-law-says-about-severance-pay-in-south-africa\/\">What the law says about severance pay in South Africa<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Employers are not legally required to pay their dismissed employees a severance package if they can find reasonable alternative employment for the dismissed employees. <\/p>\n","protected":false},"author":95,"featured_media":658877,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9872],"tags":[26,9482],"class_list":["post-664399","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-headline","tag-werksmans-attorneys"],"_links":{"self":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/664399","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/users\/95"}],"replies":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/comments?post=664399"}],"version-history":[{"count":12,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/664399\/revisions"}],"predecessor-version":[{"id":666001,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/posts\/664399\/revisions\/666001"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media\/658877"}],"wp:attachment":[{"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/media?parent=664399"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/categories?post=664399"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/businesstech.co.za\/news\/wp-json\/wp\/v2\/tags?post=664399"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
