{"id":68246,"date":"2014-09-11T14:23:40","date_gmt":"2014-09-11T12:23:40","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=68246"},"modified":"2014-09-11T14:23:40","modified_gmt":"2014-09-11T12:23:40","slug":"rica-what-is-the-point","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/68246\/rica-what-is-the-point\/","title":{"rendered":"Rica &#8211; what is the point?"},"content":{"rendered":"<p>A new report questions the point of Rica, stating that the act is &#8220;fundamentally flawed&#8221; due to a lack of transparency within the system to detect or quantify abuses.<\/p>\n<p>The Regulation of Interception of Communications and Provision of Communication-Related Information Act (Rica) is a law that makes it compulsory for everyone in South Africa to register their cellphone number.<\/p>\n<p>The act came into force o<span class=\"st\">n 1 July 2009.<\/span><\/p>\n<p>The Right2Know Campaign released its 2014 \u2018Secret State of the Nation\u2019 report, published earlier this week, and noted that, while NSA whistleblower Edward Snowden sparked a global debate about privacy and state abuses of surveillance, locally, very little information is available on the surveillance systems.<\/p>\n<p>Rica, Right2Know pointed out, requires a judge\u2019s warrant to monitor communications, and Parliament\u2019s intelligence committee is supposed to release public oversight reports, but until April 2014 it had not released any for three years.<\/p>\n<p>The information has subsequently been released, with the the report noting that it appeared that the number of authorisations to intercept users\u2019 communications more than doubled between 2008 and 2011 before dropping off dramatically.<\/p>\n<p>&#8220;However, these statistics do not give us a clear picture of the use of surveillance. They only measure how often the Rica judge issues a warrant to intercept someone\u2019s communications,&#8221; the report said.<\/p>\n<p><a  data-lightbox=\"post-image\" href=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-68250\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants.png\" alt=\"RICA warrants\" width=\"600\" height=\"426\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants.png 783w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants-300x213.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>According to the report, the facility that actually \u2018listens in\u2019 to people\u2019s communications reported to Parliament\u2019s\u00a0Joint Standing Committee on Intelligence (JSCI) in 2010 that it had made about three million interceptions over three years, during which time only 882 Rica warrants were authorised.<\/p>\n<div id=\"attachment_68256\" style=\"width: 519px\" class=\"wp-caption aligncenter\"><a  data-lightbox=\"post-image\" href=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants-issues.png\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-68256\" class=\"size-full wp-image-68256\" src=\"http:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants-issues.png\" alt=\"RICA warrants issues\" width=\"509\" height=\"280\" srcset=\"https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants-issues.png 509w, https:\/\/businesstech.co.za\/news\/wp-content\/uploads\/2014\/09\/RICA-warrants-issues-300x165.png 300w\" sizes=\"auto, (max-width: 509px) 100vw, 509px\" \/><\/a><p id=\"caption-attachment-68256\" class=\"wp-caption-text\">RICA warrants issues<\/p><\/div>\n<p>&#8220;So each warrant may represent thousands of interceptions, or else surveillance is happening without a warrant,&#8221; Right2Know said.<\/p>\n<p>&#8220;There is just not enough transparency in the system and too few safeguards to protect against abuses of surveillance.
