{"id":690101,"date":"2023-05-22T16:05:32","date_gmt":"2023-05-22T14:05:32","guid":{"rendered":"https:\/\/businesstech.co.za\/news\/?p=690101"},"modified":"2023-05-22T16:05:32","modified_gmt":"2023-05-22T14:05:32","slug":"double-blow-for-vat-in-south-africa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/finance\/690101\/double-blow-for-vat-in-south-africa\/","title":{"rendered":"Double-blow for VAT in South Africa"},"content":{"rendered":"<p>Load shedding and bad faith actors are taking their toll on value-added tax (VAT) revenue collection, says financial services firm PwC in its latest VAT and Indirect Taxes in Africa report.<\/p>\n<p>The standard VAT rate of 15% applies to all supplies of goods or services in the country &#8211; administered by the South African Revenue Service (SARS).<\/p>\n<p>VAT is levied on \u2018taxable supplies\u2019, which are supplies of goods or services made by a \u2018vendor\u2019 (a person registered or required to be registered as a VAT vendor with SARS) in the course or furtherance of an enterprise carried on by the vendor wholly or partly in South Africa.<\/p>\n<p>VAT was introduced in September of 1991 through the VAT Act, with the goal of replacing sales tax. Since 2012, the administration of tax acts has shifted mainly to the newer Tax Administration Act 28 of 2011.<\/p>\n<p>PwC said, however, that there are still certain VAT administration provisions still contained in the VAT Act.<\/p>\n<p><strong>Load shedding and bad guys<\/strong><\/p>\n<p>In <strong><a href=\"https:\/\/businesstech.co.za\/news\/finance\/681931\/big-blow-for-vat-in-south-africa-as-load-shedding-claims-another-victim\/\" target=\"_blank\" rel=\"noopener\">April<\/a> <\/strong>this year, SARS reported that rolling blackouts had cost it up to R60 billion in tax collections. SARS&#8217;s chief revenue officer Johnstone Makhuba said that there is likely going to be another deficit as a result of the lagged effect of blackouts and tax collections.<\/p>\n<p>He said that corporate income taxes over the long term are felt later following VAT collections feeling the first-hand effects of a decline in sales. As a result of this, VAT collections are expected to see a further R60 billion loss over the course of 2023 as load shedding persists.<\/p>\n<p>Another challenge facing the tax authority regarding VAT has been the need to quickly tighten its VAT registration process after detecting a high number of <strong><a href=\"https:\/\/businesstech.co.za\/news\/finance\/688033\/sars-on-a-razor-edge-coming-after-these-south-africans\/\" target=\"_blank\" rel=\"noopener\">suspicious VAT registrations<\/a><\/strong>.<\/p>\n<p>SARS reported a significant number of registrations are being deliberately established with the intention of defrauding SARS &#8211; harming the country&#8217;s fiscus and the everyday taxpayers.<\/p>\n<p>According to PwC, a person or business has to register if their\/its annual value of taxable supplies has exceeded the annual threshold of R1 million over the past 12 months.<\/p>\n<p>&#8220;Registration is not required where the threshold will be exceeded solely as a consequence of the cessation of, or substantial and permanent reduction in, the size or scale of an enterprise, the replacement of capital assets or abnormal circumstances of a temporary nature,&#8221; said the financial service firm.<\/p>\n<p>A person\/business may also apply for voluntary registration to be a VAT vendor if:<\/p>\n<ul>\n<li>Their taxable supplies have exceeded R50,000 in a preceding 12-month period<\/li>\n<\/ul>\n<ul>\n<li>They carry on an enterprise that can be expected to result in taxable supplies in excess of R50,000 during a 12-month period due to its nature<\/li>\n<\/ul>\n<ul>\n<li>They buy a business as a going concern if the previous owner made taxable supplies in excess of R50,000 in a 12-month period<\/li>\n<\/ul>\n<ul>\n<li>The entity falls within a category specified by the legislation, including but not limited to welfare organisations, share block companies, foreign donor-funded projects, municipalities etc., even if the R50,000 requirement has not been met.<\/li>\n<\/ul>\n<p>Responding to this uptick, SARS has taken a no-nonsense approach in pursuing non-compliant taxpayers and has implemented the following changes to the registration system:<\/p>\n<ul>\n<li>All new applications for VAT registration will be subjected to a more stringent verification process which could include the applicant being required to present themselves, in person, to the branch closest to where the business enterprise is located for validation and accreditation.<\/li>\n<\/ul>\n<ul>\n<li>Where applicants are expected to visit a branch, the visit must be pre-booked on the SARS website by clicking on the \u201cBook an Appointment\u201d icon.<\/li>\n<\/ul>\n<ul>\n<li>All supporting documents that are required for registration validation must be submitted at the branch on the day of the appointment.<\/li>\n<li>VAT registration will only be affected when SARS has satisfied itself that the application is lawful.<\/li>\n<\/ul>\n<p>Further developments to bring an end to illicit VAT abuses include SARS&#8217;s introduction of a domestic reverse charge mechanism on transactions relating to gold to curb VAT refunds that had been prevalent in the second-hand gold market.<\/p>\n<p>PwC said that this domestic reverse charge applies where both the supplier and recipient are registered vendors, and it places the requirement to declare the VAT on the sale of the valuable metal on the recipient and not the supplier.<\/p>\n<p><strong>VAT comparison<\/strong><\/p>\n<p>PwC&#8217;s latest report further provided a comparison of VAT rates across Africa.<\/p>\n<p>South Africa, with a 15% tax rate, shared similarities with countries like Ethiopia, Gambia, Lesotho and Seychelles.<\/p>\n<p>Some of the most notable increases coming into 2023 were seen in Burkina Faso and Togo, which went from having no VAT rate to a flat 18%.
