{"id":71756,"date":"2014-10-27T12:57:40","date_gmt":"2014-10-27T10:57:40","guid":{"rendered":"http:\/\/businesstech.co.za\/news\/?p=71756"},"modified":"2014-10-27T12:57:40","modified_gmt":"2014-10-27T10:57:40","slug":"e-toll-prosecutions-will-create-fake-criminals-jpsa","status":"publish","type":"post","link":"https:\/\/businesstech.co.za\/news\/trending\/71756\/e-toll-prosecutions-will-create-fake-criminals-jpsa\/","title":{"rendered":"E-toll prosecutions will create &#8216;fake criminals&#8217;: JPSA"},"content":{"rendered":"<p>Prosecutions for falsifying number plates to avoid e-tolls has nothing to do with people being charged for not paying their e-tolls, Justice Project South Africa (JPSA) said in a statement on Monday, 27 October 2014.<\/p>\n<p>The statement followed <a title=\"http:\/\/www.moneyweb.co.za\/moneyweb-south-africa\/enough-progress-made-for-etoll-enforcement--sanral\" href=\"http:\/\/www.moneyweb.co.za\/moneyweb-south-africa\/enough-progress-made-for-etoll-enforcement--sanral\" target=\"_blank\">a report on Moneyweb<\/a> in which it said the chief financial officer of the South African National Roads Agency Limited (Sanral), Inge Mulder, once again threatened motorists with prosecution for non-payment of e-tolls.<\/p>\n<p>This is despite the fact that e-tolling is currently under review by the Gauteng Provincial Government.<\/p>\n<p>The report quoted Mulder as saying that she is confident that enough progress has been made, with regards to the prosecution process, to effect enforcement.<\/p>\n<p>Additionally, the NPA indicated that two cases were currently being handled. The JPSA says these cases are unrelated to e-tolling, directly, however.<\/p>\n<p>\u201cThe two cases currently undergoing prosecution must not be confused with prosecutions for non-payment of e-tolls, despite the fact that Sanral has chosen to conflate these two cases with fraud charges applicable to e-tolling,\u201d JPSA chair Howard Dembovsky said.<\/p>\n<p>\u201cFalsifying and defacing number plates are criminal offences under the National Road Traffic Act. Falsified number plates would ordinarily be prosecuted under the criminal charge of fraud, with charges under the National Road Traffic Act forming alternative charges,\u201d said Dembovksy.<\/p>\n<p>He also said that by waiting more than 7 months after the first prosecutions should have started (April 2014), Sanral had created an enormous amount of prejudice \u2013 both in the money allegedly outstanding to it and the number of people that will have to be prosecuted for non-payment of e-tolls.<\/p>\n<p>\u201cIt would appear that Sanral doesn\u2019t much care what happens to the economy of South Africa if they are successful in creating a high volume of artificial criminals,\u201d Dembovsky said.<\/p>\n<p>\u201cIt is still somewhat debatable whether Sanral will be successful in prosecuting cases of the non-payment of e-tolls, but only a court will prove whether they will or will not,\u201d he added.<\/p>\n<p>Dembovsky went on to say that when it comes to the prosecution of motorists for the non-payment of e-tolls, the matter is not nearly as clear-cut as someone falsifying or defacing number plates.<\/p>\n<p>\u201cProsecuting the two clearly criminal matters cited by Sanral is a far cry from prosecuting hundreds of thousands, if not over a million, individuals for non-payment of e-tolls,\u201d Dembovsky argued.<\/p>\n<p>He added that if Sanral is planning to violate the Constitution by selecting a few choice matters to prosecute in the hope that they can scare others into submission, they need to be aware of the fact that this will not simply be overlooked.<\/p>\n<p>\u201cIf they are successful in prosecuting large volumes of e-tolls \u2018offenders\u2019, they will create an environment of unemployable artificial criminals and will, as a result, cripple the economy of South Africa,\u201d Dembovsky said.<\/p>\n<h3 class=\"my-4\">More on Sanral<\/h3>\n<p><strong><a title=\"Permalink to Sanral changes tune on e-toll panel: report\" href=\"http:\/\/businesstech.co.za\/news\/general\/71249\/sanral-changes-tune-on-e-toll-panel-report\/\" rel=\"bookmark\">Sanral changes tune on e-toll panel: report<\/a><\/strong><\/p>\n<p><strong><a title=\"Permalink to Want to see e-toll records?
